Amends the Nursing Home Care Act. Provides that the Department of Public Health's rules in connection with nursing home inspections and surveys must allow for flexibility in the survey process and the timing of inspections in the case of facilities that have a satisfactory record of meeting the requirements under the Act. Effective immediately.

| AN ACT concerning regulation.
|

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The Nursing Home Care Act is amended by changing |
5 |
| Section 3-107 as follows:
|

| (210 ILCS 45/3-107) (from Ch. 111 1/2, par. 4153-107)

| Sec. 3-107. Inspections; surveys.
|
8 |
| (a) The Department and the city, village or incorporated |
9 |
| town shall
have the right at any time to visit and inspect the |
10 |
| premises and personnel
of any facility for the purpose of |
11 |
| determining whether the applicant or
licensee is in compliance |
12 |
| with this Act or with the local ordinances which
govern the |
13 |
| regulation of the facility. The Department may survey any |
14 |
| former
facility which once held a license to ensure that the |
15 |
| facility is not again
operating without a license. |
16 |
| Municipalities may charge a reasonable license
or renewal fee |
17 |
| for the regulation of facilities, which fees shall be in
|
18 |
| addition to the fees paid to the Department. |
19 |
| (b) The Department's rules in connection with facility |
20 |
| inspections and surveys must allow for flexibility in the |
21 |
| survey process and the timing of inspections in the case of |
22 |
| facilities that have a satisfactory record of meeting the |
23 |
| requirements under this Act.

| Section 99. Effective date. This Act takes effect upon |
