| AMENDMENT NO. ______. Amend House Bill 1999 by replacing |

| everything after the enacting clause with the following:

| "Section 5. The Critical Health Problems and Comprehensive |
5 |
| Health
Education Act is amended by changing Section 3 as |
6 |
| follows:
|

| (105 ILCS 110/3) (from Ch. 122, par. 863)
|

| Sec. 3. Comprehensive Health Education Program. The |
9 |
| program established
under this Act shall include, but not be |
10 |
| limited to, the following major
educational areas as a basis |
11 |
| for curricula in all elementary and secondary
schools in this |
12 |
| State: human ecology and health, human growth and
development, |
13 |
| the emotional, psychological, physiological, hygienic and
|
14 |
| social responsibilities of family life, including sexual |
15 |
| abstinence until
marriage, prevention and control of disease, |
16 |
| including instruction in
grades 6 through 12 on the prevention, |
17 |
| transmission and spread of AIDS,
public and environmental |
18 |
| health, consumer health, safety education and
disaster |
19 |
| survival, mental health and illness, personal health habits,
|
20 |
| alcohol, drug use, and abuse including the medical and legal |
21 |
| ramifications
of alcohol, drug, and tobacco use, abuse during |
22 |
| pregnancy, sexual
abstinence until marriage, tobacco, |
23 |
| nutrition, and dental health.
Notwithstanding the above |
24 |
| educational areas, the following areas may also
be included as |

| a basis for curricula in all elementary and secondary
schools |
2 |
| in this State: basic first aid (including, but not limited to,
|
3 |
| cardiopulmonary resuscitation and the Heimlich maneuver), |
4 |
| early prevention
and detection of cancer, heart disease, |
5 |
| diabetes, stroke, and the
prevention of child abuse, neglect, |
6 |
| and suicide.
The school board of each public elementary and |
7 |
| secondary school in the State shall require all teachers and |
8 |
| other school personnel to acquire, develop, and maintain the |
9 |
| knowledge and skills necessary to properly administer |
10 |
| cardiopulmonary resuscitation. The school board of each
public |
11 |
| elementary and secondary school in the State
shall encourage |
12 |
| all teachers and other school personnel to acquire,
develop, |
13 |
| and maintain the knowledge and skills necessary to properly
|
14 |
| administer other life-saving techniques, including without |
15 |
| limitation the
Heimlich maneuver and rescue breathing.
The |
16 |
| training shall be in
accordance with standards of the
American |
17 |
| Red Cross, the American Heart Association, or another |
18 |
| nationally
recognized certifying organization.
A school board |
19 |
| may use the
services of non-governmental entities whose |
20 |
| personnel have expertise in
life-saving techniques to instruct |
21 |
| teachers and other school personnel in
these techniques. Each |
22 |
| school board
is encouraged to have in
its employ, or on its |
23 |
| volunteer staff, at least one person who is certified, by
the |
24 |
| American Red Cross or by another qualified certifying agency,
|
25 |
| as qualified to administer first aid and
cardiopulmonary |
26 |
| resuscitation . In addition, each school board is authorized to
|
27 |
| allocate appropriate portions of its institute or inservice |
28 |
| days to conduct
training programs for teachers and other school |
29 |
| personnel who have expressed an
interest in becoming qualified |
30 |
| to administer emergency first aid or
who are required to become |
31 |
| qualified to administer cardiopulmonary resuscitation. School |
32 |
| boards are urged to
encourage their teachers and other school |
33 |
| personnel who coach school athletic
programs and other |
34 |
| extracurricular school activities to acquire, develop, and
|

| maintain the knowledge and skills necessary to properly |
2 |
| administer first aid
and cardiopulmonary resuscitation in |
3 |
| accordance with standards and requirements
established by the |
4 |
| American Red Cross or another qualified certifying agency.
No |
5 |
| pupil shall be
required to take or participate in any class or |
6 |
| course on AIDS or family
life instruction if his parent or |
7 |
| guardian submits written objection
thereto, and refusal to take |
8 |
| or participate in the course or program shall
not be reason for |
9 |
| suspension or expulsion of the pupil.
|
10 |
| Curricula developed under programs established in |
11 |
| accordance with this
Act in the major educational area of |
12 |
| alcohol and drug use and abuse shall
include classroom |
13 |
| instruction in grades 5 through 12. The instruction,
which |
14 |
| shall include matters relating to both the physical and legal |
15 |
| effects
and ramifications of drug and substance abuse, shall be |
16 |
| integrated into
existing curricula; and the State Board of |
17 |
| Education shall develop and make
available to all elementary |
18 |
| and secondary schools in this State
instructional materials and |
19 |
| guidelines which will assist the schools in
incorporating the |
20 |
| instruction into their existing curricula. In
addition, school |
21 |
| districts may offer, as part of existing curricula during
the |
22 |
| school day or as part of an after school program, support |
23 |
| services and
instruction for pupils or pupils whose parent, |
24 |
| parents, or guardians are
chemically dependent.
