| AN ACT concerning civil law.
|

| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|

| Section 5. The Illinois Marriage and Dissolution of |
5 |
| Marriage Act is amended by changing Section 609 as follows:
|

| (750 ILCS 5/609) (from Ch. 40, par. 609)
|

| Sec. 609. Leave to Remove Children.) (a) The court may |
8 |
| grant leave, before
or after judgment, to any party having |
9 |
| custody of any minor child or children
to remove such child or |
10 |
| children from Illinois whenever such approval is
in the best |
11 |
| interests of such child or children. The burden of proving that
|
12 |
| such removal is in the best interests of such child or children |
13 |
| is on the
party seeking the removal. The court may consider the |
14 |
| financial advantage to the custodial parent when determining |
15 |
| the best interest of the child. When such removal is permitted, |
16 |
| the court may
require the party removing such child or children |
17 |
| from Illinois
to give reasonable security guaranteeing the |
18 |
| return of such children.

| (b) Before a minor child is temporarily removed from |
20 |
| Illinois, the
parent responsible for the removal shall inform |
21 |
| the other parent, or the
other parent's attorney, of the |
22 |
| address and telephone number where the
child may be reached |
23 |
| during the period of temporary removal, and the date
on which |
24 |
| the child shall return to Illinois.

25 |
| The State of Illinois retains jurisdiction when the minor |
26 |
| child is
absent from the State pursuant to this subsection.
