| 1 | AMENDMENT TO HOUSE BILL 596

| 2 | AMENDMENT NO. ______. Amend House Bill 596, AS AMENDED, by | ||||||
| 3 | replacing everything after the enacting clause with the | ||||||
| 4 | following:
| ||||||
| 5 | "Section 5. The Criminal Code of 1961 is amended by adding | ||||||
| 6 | Sections 2-6.6, 32-5.4, 32-5.5, 32-5.6, and 32-5.7 as follows: | ||||||
| 7 | (720 ILCS 5/2-6.6 new)
| ||||||
| 8 | Sec. 2-6.6. Emergency management worker. | ||||||
| 9 | "Emergency management worker" shall include the following: | ||||||
| 10 | (a) any person, paid or unpaid, who is a member of a | ||||||
| 11 | local or county emergency services and disaster agency as | ||||||
| 12 | defined by the Illinois Emergency Management Agency Act, or | ||||||
| 13 | who is an employee of the Illinois Emergency Management | ||||||
| 14 | Agency or the Federal Emergency Management Agency;
| ||||||
| 15 | (b) any employee or volunteer of the American Red | ||||||
| 16 | Cross;
| ||||||
| 17 | (c) any employee of a federal, State, county or local | ||||||
| 18 | government agency assisting an emergency services and | ||||||
| 19 | disaster agency, the Illinois Emergency Management Agency, | ||||||
| 20 | or the Federal Emergency Management Agency through mutual | ||||||
| 21 | aid or as otherwise requested or directed in time of | ||||||
| 22 | disaster or emergency; and
| ||||||
| 23 | (d) any person volunteering or directed to assist an | ||||||
| 24 | emergency services and disaster agency, the Illinois | ||||||

| 1 | Emergency Management Agency, or the Federal Emergency | ||||||
| 2 | Management Agency.

| 3 | (720 ILCS 5/32-5.4 new) | ||||||
| 4 | Sec. 32-5.4. False personation of a fire fighter. A person | ||||||
| 5 | who knowingly and falsely represents himself to be a fire | ||||||
| 6 | fighter of any jurisdiction commits a Class 4 felony. | ||||||
| 7 | (720 ILCS 5/32-5.5 new) | ||||||
| 8 | Sec. 32-5.5. Aggravated false personation of a fire | ||||||
| 9 | fighter. A person who knowingly and falsely represents himself | ||||||
| 10 | to be a fire fighter of any jurisdiction in attempting or | ||||||
| 11 | committing a felony commits a Class 3 felony. | ||||||
| 12 | (720 ILCS 5/32-5.6 new)
| ||||||
| 13 | Sec. 32-5.6. False personation of an emergency management | ||||||
| 14 | worker. A person who knowingly and falsely represents himself | ||||||
| 15 | to be an emergency management worker of any jurisdiction in | ||||||
| 16 | this State or of the American Red Cross commits a Class 4 | ||||||
| 17 | felony. For purposes of this Section, "emergency management | ||||||
| 18 | worker" shall have the same meaning as provided under Section | ||||||
| 19 | 2-6.6 of this Code. | ||||||
| 20 | (720 ILCS 5/32-5.7 new)
| ||||||
| 21 | Sec. 32-5.7. Aggravated false personation of an emergency | ||||||
| 22 | management worker. A person who knowingly and falsely | ||||||
| 23 | represents himself to be an emergency management worker of any | ||||||
| 24 | jurisdiction in this State or of the American Red Cross in | ||||||
| 25 | attempting or committing a felony commits a Class 3 felony. For | ||||||
| 26 | purposes of this Section, "emergency management worker" shall | ||||||
| 27 | have the same meaning as provided under Section 2-6.6 of this | ||||||
| 28 | Code.".
