Amends the Communicable Disease Prevention Act. Provides that rules adopted by the Department of Public Health concerning immunization of children against preventable communicable diseases must require separate vaccinations for measles, for mumps, and for rubella and may not permit a single vaccination for all 3 diseases.

| AN ACT concerning health.
|
2 |
| Be it enacted by the People of the State of Illinois,
|
3 |
| represented in the General Assembly:
|
4 |
| Section 5. The Communicable Disease Prevention Act is |
5 |
| amended by changing Section 2 as follows:
|
6 |
| (410 ILCS 315/2) (from Ch. 111 1/2, par. 22.12)

| Sec. 2. The Department of Public Health shall promulgate |
8 |
| rules and
regulations requiring immunization of children |
9 |
| against preventable communicable
diseases designated by the |
10 |
| Director. Before any regulation or amendment
thereto is |
11 |
| prescribed, the Department shall conduct a public hearing
|
12 |
| regarding such regulation.
In addition, before any regulation |
13 |
| or any amendment to a regulation is
adopted,
and after the |
14 |
| Immunization Advisory Committee has made its recommendations,
|
15 |
| the State Board of Health shall conduct 3 public hearings,
|
16 |
| geographically
distributed throughout the State, regarding the |
17 |
| regulation or amendment to the
regulation. At the conclusion of |
18 |
| the hearings, the State Board of Health shall
issue a report, |
19 |
| including its recommendations, to the Director. The Director
|
20 |
| shall take into consideration any comments or recommendations |
21 |
| made by the Board
based on these hearings.
The Department may |
22 |
| prescribe additional rules
and regulations for immunization of |
23 |
| other diseases as vaccines are
developed.

| Notwithstanding any other provision of this Section, the |
25 |
| rules adopted by the Department of Public Health concerning |
26 |
| immunization of children against preventable communicable |
27 |
| diseases must require separate vaccinations for measles, for |
28 |
| mumps, and for rubella and may not permit a single vaccination |
29 |
| for all 3 diseases.

30 |
| The provisions of this Act shall not apply if:
|
31 |
| 1. The parent or guardian of the child objects thereto on |
32 |
| the grounds
that the administration of immunizing agents |
