 1        AN ACT concerning insurance.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.  The  Illinois  Insurance  Code is amended by
 5    adding Section 155.39 as follows:

 6        (215 ILCS5/155.39 new)
 7        Sec.  155.39.  Auto   insurance;   premium   rates.    An
 8    insurance company authorized to do business in this State may
 9    not,  with  respect to a policy that insures against any loss
10    or liability resulting from or  incident  to  the  ownership,
11    maintenance,  or  use of a motor vehicle, base premium rates,
12    in whole or in part, upon  the  fact  that  the  insured  was
13    involved  in an accident if there is no claim based upon that
14    accident of if the claim for that accident is paid by  or  on
15    behalf of a party to the accident other than the insured.
