 1        AN ACT concerning highway advertising.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 1.  The Highway Advertising Control Act  of  1971
 5    is amended by changing Section 10 as follows:

 6        (225 ILCS 440/10) (from Ch. 121, par. 510)
 7        Sec.  10.   Unlawful  signs.   The  following  signs  are
 8    unlawful and a public nuisances nuisance:
 9        (a)  Signs  erected  after the effective date of this Act
10    in violation of this Act;
11        (b)  Signs not registered in accordance with this Act  or
12    in   accordance  with  the  regulations  established  by  the
13    Department;
14        (c)  Signs without valid permits, as required by this Act
15    or by regulations established by the Department;
16        (d)  Signs advertising  alcoholic  beverages  or  tobacco
17    products  located  within  1,000  feet  of  any elementary or
18    secondary school.
19        Each sign declared by this Section to be unlawful  and  a
20    public  nuisance  shall be removed or brought into compliance
21    with this Act by the owner, without compensation,  within  30
22    days  after  receipt  of  notice  by  certified mail from the
23    Department, such notice period to be computed from  the  date
24    of  mailing.   If  the  unlawful  sign  is affixed to a motor
25    vehicle or a  trailer  or  other  vehicle  capable  of  being
26    propelled  by  a  motor  vehicle,  it shall be removed by the
27    owner, without compensation, within  24  hours  after  verbal
28    notice  by  the  Department.  Any signs not so removed by the
29    owners or any such signs which  are  removed  and  re-erected
30    illegally  by  the  owners  shall  become the property of the
31    State and shall be removed and disposed of by the  Department

 1    or  may be painted over by the Department.  The Department is
 2    also granted authority to enter  upon  private  property  for
 3    these  purposes.  If the name and address of the owner of the
 4    sign cannot be ascertained from the records of the Department
 5    or from a visual inspection of the sign, notices provided for
 6    by this Section foregoing notice provisions are not  required
 7    and  the  Department shall take immediate action to remove or
 8    paint over the sign.
