093_SB0809 LRB093 08523 DRJ 08747 b 1 AN ACT in relation to mental health. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Mental Health and Developmental 5 Disabilities Administrative Act is amended by adding Section 6 72 as follows: 7 (20 ILCS 1705/72 new) 8 Sec. 72. DuPage County intermittent care group homes. 9 (a) Definition. In this Section, "Service Provider" 10 means Trinity Services of Joliet, Illinois. 11 (b) The Department shall establish in DuPage County 2 12 group homes, each housing 4 residents with similar diagnoses 13 of mental illness and requiring similar intermittent care. 14 The homes must be located in DuPage County and within 15 reasonable proximity of each other. The homes must have 16 similar characteristics and be approved by the United States 17 Department of Housing and Urban Development for Section 8 18 Project-Based Assistance. 19 (c) The Department shall purchase each home with 20 down-payment moneys provided by (i) the family of one of the 21 home's residents through an established special needs trust 22 and (ii) a not-for-profit provider of services for the 23 mentally ill. 24 (d) The Department shall rent each home to the Service 25 Provider at a fair market rental value as determined by the 26 DuPage Housing Authority. The rent must cover payment of 27 principal and interest on the mortgage on each home, as well 28 as payment of taxes and insurance on the properties and the 29 cost of reasonably expected repairs and maintenance. 30 (e) The Service Provider shall pay all principal and 31 interest under the mortgage on each of the homes as those -2- LRB093 08523 DRJ 08747 b 1 amounts come due and shall pay the cost of property taxes and 2 insurance on the homes and the cost of repairs and 3 maintenance on the homes. The Service Provider shall pay for 4 utility service to the homes. 5 (f) The General Assembly anticipates that the United 6 States Department of Housing and Urban Development will pay 7 to the Service Provider a monthly amount as rent on behalf of 8 each resident. The Department also anticipates that residents 9 will pay rent monthly to the Service Provider in an amount 10 approved by the Department. 11 (g) The Department shall contract with the Service 12 Provider to provide all necessary and customary services to 13 the residents of the homes. The Service Provider must ensure 14 that sufficient employees are assigned to each home to meet 15 the needs of the residents and to comply with the level of 16 care necessary for the residents. The Service Provider shall 17 also provide the residents of each home with transportation 18 to daily programs, social events, counseling, therapy, 19 physician appointments, and places of employment. 20 (h) The Department and the Service Provider must take 21 all steps necessary to enroll the residents of the homes as 22 recipients of medical assistance under Article V of the 23 Illinois Public Aid Code and to seek reimbursement under that 24 program for services provided to the residents.
