093_HB2185eng HB2185 Engrossed LRB093 04403 LCB 04453 b 1 AN ACT concerning vehicles. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The State Finance Act is amended by adding 5 Section 5.595 as follows: 6 (30 ILCS 105/5.595 new) 7 Sec. 5.595. The Blindness Prevention Fund. 8 Section 10. The Illinois Identification Card Act is 9 amended by changing Section 5 as follows: 10 (15 ILCS 335/5) (from Ch. 124, par. 25) 11 Sec. 5. Applications. 12 (a) Any natural person who is a resident of the State of 13 Illinois, may file an application for an identification card 14 or for the renewal thereof, in a manner prescribed by the 15 Secretary. Each original application shall be completed by 16 the applicant in full and shall set forth the name, address 17 and zip code, social security number, birth date, sex and a 18 brief description of the applicant. The applicant shall be 19 photographed and he shall also submit any other information 20 as the Secretary may deem necessary or such documentation as 21 the Secretary may require to determine the identity of the 22 applicant. An applicant for a disabled persons card must 23 also submit with each original or renewal application, on 24 forms prescribed by the Secretary, such documentation as the 25 Secretary may require, establishing that the applicant is a 26 "disabled person" as defined in Section 4A of this Act, and 27 setting forth the applicant's type and class of disability as 28 set forth in Section 4A of this Act. 29 (b) In addition to the fees collected under Section 12 HB2185 Engrossed -2- LRB093 04403 LCB 04453 b 1 of this Act, the Secretary of State shall ask each person 2 applying for or renewing a State identification card whether 3 the person wishes to make a $1 voluntary contribution to the 4 Blindness Prevention Fund established under Section 6-106 of 5 the Illinois Vehicle Code. All donations collected under this 6 subsection (b) shall be deposited into the Blindness 7 Prevention Fund. 8 (Source: P.A. 89-569, eff. 1-1-97.) 9 Section 15. The Illinois Vehicle Code is amended by 10 changing Sections 6-106 and 6-510 as follows: 11 (625 ILCS 5/6-106) (from Ch. 95 1/2, par. 6-106) 12 Sec. 6-106. Application for license or instruction 13 permit. 14 (a) Every application for any permit or license 15 authorized to be issued under this Act shall be made upon a 16 form furnished by the Secretary of State. Every application 17 shall be accompanied by the proper fee and payment of such 18 fee shall entitle the applicant to not more than 3 attempts 19 to pass the examination within a period of 1 year after the 20 date of application. 21 (b) Every application shall state the name, social 22 security number, zip code, date of birth, sex, and residence 23 address of the applicant; briefly describe the applicant; 24 state whether the applicant has theretofore been licensed as 25 a driver, and, if so, when and by what state or country, and 26 whether any such license has ever been cancelled, suspended, 27 revoked or refused, and, if so, the date and reason for such 28 cancellation, suspension, revocation or refusal; shall 29 include an affirmation by the applicant that all information 30 set forth is true and correct; and shall bear the applicant's 31 signature. The application form may also require the 32 statement of such additional relevant information as the HB2185 Engrossed -3- LRB093 04403 LCB 04453 b 1 Secretary of State shall deem necessary to determine the 2 applicant's competency and eligibility. The Secretary of 3 State may in his discretion substitute a federal tax number 4 in lieu of a social security number, or he may instead assign 5 an additional distinctive number in lieu thereof, where an 6 applicant is prohibited by bona fide religious convictions 7 from applying or is exempt from applying for a social 8 security number. The Secretary of State shall, however, 9 determine which religious orders or sects have such bona fide 10 religious convictions. The Secretary of State may, in his 11 discretion, by rule or regulation, provide that an 12 application for a drivers license or permit may include a 13 suitable photograph of the applicant in the form prescribed 14 by the Secretary, and he may further provide that each 15 drivers license shall include a photograph of the driver. The 16 Secretary of State may utilize a photograph process or system 17 most suitable to deter alteration or improper reproduction of 18 a drivers license and to prevent substitution of another 19 photo thereon. 20 (c) The application form shall include a notice to the 21 applicant of the registration obligations of sex offenders 22 under the Sex Offender Registration Act. The notice shall be 23 provided in a form and manner prescribed by the Secretary of 24 State. For purposes of this subsection (c), "sex offender" 25 has the meaning ascribed to it in Section 2 of the Sex 26 Offender Registration Act. 27 (d) Any male United States citizen or immigrant who 28 applies for any permit or license authorized to be issued 29 under this Act or for a renewal of any permit or license, and 30 who is at least 18 years of age but less than 26 years of 31 age, must be registered in compliance with the requirements 32 of the federal Military Selective Service Act. The Secretary 33 of State must forward in an electronic format the necessary 34 personal information regarding the applicants identified in HB2185 Engrossed -4- LRB093 04403 LCB 04453 b 1 this subsection (d) to the Selective Service System. The 2 applicant's signature on the application serves as an 3 indication that the applicant either has already registered 4 with the Selective Service System or that he is authorizing 5 the Secretary to forward to the Selective Service System the 6 necessary information for registration. The Secretary must 7 notify the applicant at the time of application that his 8 signature constitutes consent to registration with the 9 Selective Service System, if he is not already registered. 10 (e) In addition to the fees collected under Section 11 6-118 of this Act, the Secretary of State shall ask each 12 person applying for or renewing a license or instruction 13 permit whether the person wishes to make a $1 voluntary 14 contribution to the Blindness Prevention Fund established 15 under this Section. All donations collected under this 16 subsection (e) shall be deposited into the Blindness 17 Prevention Fund. 18 (f) The Blindness Prevention Fund is created as a 19 special fund in the State treasury. All moneys in the Fund 20 shall, subject to appropriation by the General Assembly, be 21 used by the Department of Human Services for grants to 22 provide blindness education, screening, and treatment. 23 (Source: P.A. 92-117, eff. 1-1-02.) 24 (625 ILCS 5/6-510) (from Ch. 95 1/2, par. 6-510) 25 Sec. 6-510. Application for Commercial Driver's License 26 (CDL). 27 (a) The application for a CDL or commercial driver 28 instruction permit, must include, but not necessarily be 29 limited to, the following: 30 (1) the full name and current Illinois domiciliary 31 address (unless the application is for a Non-resident 32 CDL) of the applicant; 33 (2) a physical description of the applicant HB2185 Engrossed -5- LRB093 04403 LCB 04453 b 1 including sex, height, weight, color of eyes and hair 2 color; 3 (3) date of birth; 4 (4) the applicant's social security number or other 5 identifying number acceptable to the Secretary of State; 6 (5) the applicant's signature; 7 (6) certifications required by 49 C.F.R. Part 8 383.71; and 9 (7) any other information required by the Secretary 10 of State. 11 (b) In addition to the fees collected under Section 12 6-118 of this Act, the Secretary of State shall ask each 13 person applying for or renewing a CDL or commercial 14 instruction permit whether the person wishes to make a $1 15 voluntary contribution to the Blindness Prevention Fund 16 established under Section 6-106 of this Code.
