Home Rule Note (H-AM 1) (Dept of Commerce and Community Affairs)
HB 1518 (HA #1) contains language stating that a unit of local government, including a home rule unit, many not regulate the acquisition, possession, transportation, storage, purchase, sale, or other dealing in rifles and shotguns, and may not regulate ammunition, components, accessories, or accoutrements for rifles and shotguns in a manner other than that provided by the Criminal Code of 1961. This is a limitation of home rule powers and functions under Article VII, Section 6, subsection (i) of the Illinois Constitution of 1970. Therefore, in the opinion of DCCA, HB 1518 (HA #1) pre-empts home rule authority. |
State Mandates Fiscal Note (H-AM 1) (Dept of Commerce and Community Affairs)
The legislation does not require local governments to expend additional revenue. Therefore, in the opinion of DCCA, HB 1518 (HA #1) does not create a State Mandate under the State Mandates Act. |
Fiscal Note (H-AM 1) (Department of Corrections)
House Bill 1518 as amended by House Amendment #1 voids any local ordinance or resolution that imposes restrictions on rifles and shotguns and their ammunition, components, and accessories that are not outlined in the Illinois Compiled Statutes. This legislation may result in an increase in the number of felony cases that could be prosecuted for unlawful possession of firearms and firearm ammunition, and possibly increase the number of offenders sentenced to a term of imprisonment. There are not enough available data to make an objective determination regarding the impact of this legislation. However, the impact on the Department is expected to be minimal. |
Correctional Note (H-AM 1) (Department of Corrections)
House Bill 1518, as amended by House Amendment #1, voids any local ordinance or resolution that imposes restrictions on rifles and shotguns and their ammunition, components, and accessories that are not outlined in the Illinois Compiled Statutes. Pension Note (H-AM 1 & 2) (Pension Laws Commission)
As HB 1518, as amended by House Amendment 1 and 2, does not amend the Pension Code, it has no fiscal impact on any public pension fund or retirement system in Illinois. |
Balanced Budget Note (H-AM 2) (Bureau of the Budget)
Section 10 of the Balanced Budget Note Act requires the preparation of a Balanced Budget Note for supplemental appropriation bills. Since this House Bill is not a supplemental appropriation bill, it is not possible to complete this Note as requested. |
Land Conveyance Appraisal Note (H-AM2) (Department of Transportation)
As there are no parcels of land being conveyed in this bill, there are no appraisals to be filed by the Dept. of Transportation. |
Fiscal Note (H-AM 2) (Illinois State Police)
HB 1518 (HA #2) would have no fiscal impact on the Illinois State Police. |
State Debt Impact Note (H-AM 2) (Economic and Fiscal Commission)
HB 1518, as amended by House Floor Amendment 2, would not change the amount of authorization for any type of State-issued or State-supported bond, and, therefore, would not affect the level of State indebtedness. |
Home Rule Note (H-AM2) (Dept of Commerce and Community Affairs)
Does pre-empt home rule authority. |
State Mandates Fiscal Note (H-AM2) (Dept of Commerce and Community Affairs)
Does not create a state mandate under the States Mandates Act. |
Housing Affordability Impact Note (H-AM 2) (Housing Development Authority)
There will be no fiscal effect on the cost of constructing, purchasing, owning or selling a single-family residence. |
Judicial Note (H-AM 2) (Admin Office of the Illinois Courts)
Based on a review of HB 1518, it has been determined that the bill would neither increase nor decrease the number of judges needed in the state. |
Fiscal Note (H-AM 2) (Department of Corrections)
House Bill 1518 as amended by House Amendment #2 voids any local ordinance or resolution that imposes restrictions on rifles and shotguns and their ammunition, components, and accessories that are not outlined in the Illinois Compiled Statutes, but allows local governments to establish zoning and security requirements for the retail sale of firearms by federally licensed firearms dealers. |
