Synopsis As Introduced
Creates the Victims of Stalking and Domestic Violence Address Confidentiality Act. Provides that a person at least 18 years of age, a parent or guardian acting on behalf of a minor, or a guardian acting on behalf of an incapacitated person may apply to the Attorney General to have an address designated by the Attorney General serve as the person's address or the address of the minor or incapacitated person. Provides that the program is applicable to persons who are victims of stalking or domestic violence. Provides that an application shall be completed in person at a community-based victims' assistance program. Provides for procedures to establish eligibility for the program and conditions for withdrawal or termination from the program. Provides that the application process shall include a requirement that the applicant shall meet with a victims' assistance counselor and receive orientation information about the program. Provides that the Act is repealed on January 1, 2014. Amends the Election Code. Provides for confidential voter registration of persons who are participants in the program. Amends the Illinois Vehicle Code to prohibit disclosure of motor vehicle registration and driver's license records of persons who are participants in the program. Provides for limited disclosure of the information to law enforcement agencies, the courts, and certain other entities. Amends the Code of Civil Procedure to permit participants of the program to change their names without disclosing their identity in public notices of the change of name.

House Amendment No. 1
Deletes everything after the enacting clause. Incorporates the provisions of the bill as introduced but provides that the evaluation of the program shall also be conducted to determine whether the program meets the needs of those victims. Provides that an application for participation in the program shall be completed in person at a designated community-based victims' assistance program. Deletes provision that an agent designated for the service of process on a program participant shall record the Attorney General's action. Provides that the address confidentiality program manager shall also notify any schools attended by the program participant or his or her children of the program participant's certification, withdrawal, or termination.
