Synopsis As Introduced
Amends the Disaster Relief Act. Defines "disaster" to include public health emergencies and acts of domestic terrorism. Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois and amends the Illinois Emergency Management Agency Act. Provides for the Department and the Agency to coordinate with respect to planning for and responding to public health emergencies. Defines "disaster" to include public health emergencies. Defines "public health emergency". Provides that the Governor must deposit transfers and loan proceeds into and make expenditures from the Disaster Relief Fund. Provides for the General Assembly to restore moneys used from other funds to meet disaster needs. Effective immediately.

 Fiscal Note (Illinois Emergency Management Agency)
 The fiscal impact of House Bill 6 is determined by the amount of state disaster assistance provided. A state disaster declaration occurs by proclamation of the Governor upon advice from the Illinois Emergency Management Agency. A state declaration allows for the availability of state resources to provide emergency or disaster assistance. These resources may be in the form of State agency services or through financial assistance from State Disaster Relief appropriations. Although there is no appropriation to IEMA in FY03 for state disaster assistance, subsection (a) of section 9 of the Illinois Emergency Management Act says "It is the intent of the Legislature and declared to be the policy of the State that funds to meet disasters shall always be available." IEMA was appropriated $2,450,000 for state disaster relief in FY02 and expended $835,937, appropriated $2.5 million in FY01 for state disaster relief and expended $654,288 and was appropriated $2.5 million in FY00 and expended $1,302,589. Section 3 of the Disaster Relief Act says "The fund shall be used for furnishing emergency services and relief to the disaster area as a whole and shall not be used to provide private relief to persons sustaining property damages or personal injury as a result of a disaster.

 Fiscal Note (Department of Public Health)
 The substantive changes, in and of themselves, would not require additional expenditures on the part of the State. It can be assumed, however, that should a public health emergency occur, funds would be expended through this provision. The amount reimbursed to localities would be dependent upon the amount appropriated to the fund and the extent of costs incurred due to the emergency. There is no way to predict possible expenditures beyond the possibility of expending up to the amount appropriated for this purpose. As the fund is administered by IEMA, there may be costs associated with that agency's administration that are not reflected in this note.

Amends the Emergency Medical Services Systems Act. Provides that in awarding funds to support disaster preparedness by first responders, the Illinois Department of Public Health and other State agencies shall take into account the role of hospitals in being prepared to respond to emergencies or disasters. Contains legislative findings regarding the role of hospitals as first responders.
