SYNOPSIS AS INTRODUCED:
 
20 ILCS 805/805-135 new

    Amends the Department of Natural Resources (Conservation) Law. Creates the Kankakee and Iroquois Counties Floodwater Mitigation Commission. Provides that the Commission shall: study floodplain policies and actions in neighboring states and counties and the impact on Kankakee and Iroquois Counties; identify and evaluate critical flooding and drainage issues and needs in Kankakee and Iroquois Counties; and make recommendations on how best to address flooding and drainage issues in Kankakee and Iroquois Counties. Sets forth provisions concerning membership of the Commission. Provides that members of the Commission shall not receive compensation. Requires the Commission to meet at least quarterly at the call of the chair and to file a report with the Governor and General Assembly by January 1, 2027 on its recommendations for flooding and drainage control in Kankakee and Iroquois Counties. Requires the Department of Natural Resources to provide administrative support to the Commission. Dissolves the Commission after the report has been filed.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Natural Resources
5(Conservation) Law of the Civil Administrative Code of
6Illinois is amended by adding Section 805-135 as follows:
 
7    (20 ILCS 805/805-135 new)
8    Sec. 805-135. The Kankakee and Iroquois Counties
9Floodwater Mitigation Commission.    (a) The Kankakee and
10Iroquois Counties Floodwater Mitigation Commission is hereby
11created. The Commission shall:
12        (1) study floodplain policies and actions in
13    neighboring states and counties and the impact on Kankakee
14    and Iroquois Counties;
15        (2) identify and evaluate critical flooding and
16    drainage issues and needs in Kankakee and Iroquois
17    Counties; and
18        (3) make recommendations on how best to address
19    flooding and drainage issues in Kankakee and Iroquois
20    Counties.
21    (b) The Commission shall consist of the following members:
22        (1) the Director of the Office of Water Resources of
23    the Department of Natural Resources or the Director's

1    designee, who shall serve as chair;
2        (2) the Director of Agriculture or the Director's
3    designee;
4        (3) the Director of the Environmental Protection
5    Agency or Director's designee;
6        (4) the Secretary of Transportation or the Secretary's
7    designee;
8        (5) the Director of the Illinois Emergency Management
9    Agency and Office of Homeland Security or the Director's
10    designee;
11        (6) the Director of the Illinois State Water Survey
12    Division of the Prairie Research Institute of the
13    University of Illinois;
14        (7) one member representing an association of
15    professionals interested in and responsible for floodplain
16    and stormwater management in the State of Illinois,
17    appointed by the Director of Natural Resources;
18        (8) one representative of an association representing
19    Illinois farmers, appointed by the Director of Natural
20    Resources;
21        (9) one representative of an association focused on
22    environmental issues, appointed by the Director of Natural
23    Resources;
24        (10) 2 members representing an association
25    representing Soil and Water Conservation;
26        (11) one member representing Kankakee County,

1    appointed by the Director of Natural Resources; and
2        (12) one member representing Iroquois County,
3    appointed by the Director of Natural Resources.
4    (c) Members of the Commission shall not receive
5compensation.
6    (d) The Commission shall meet at least quarterly at the
7call of the chair and shall file a report with the Governor and
8General Assembly by January 1, 2027 on its recommendations for
9flooding and drainage control in Kankakee and Iroquois
10Counties.
11    (e) The Department of Natural Resources shall provide
12administrative support to the Commission.
13    (f) After the report required under this Section has been
14filed, the Commission shall be dissolved.
