SYNOPSIS AS INTRODUCED:
 
New Act
815 ILCS 505/2HHHH new

    Creates the Paper Waste Reduction Act. Sets forth limits on the amount of junk mail a for-profit corporation, association, limited liability company, partnership, not-for-profit organization, or other legal entity shall send or cause to be sent to a person residing in the State. Provides that a violation of any of the provisions of the Act is an unlawful practice under the Consumer Fraud and Deceptive Business Practices Act. Amends the Consumer Fraud and Deceptive Business Practices Act making to make a conforming change.

1    AN ACT concerning business.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the Paper
5Waste Reduction Act.
 
6    Section 5. Definition. As used in this Act, "junk mail"
7means any printed matter sent by mail that is not sent at the
8request of or with the express consent of the recipient for the
9purpose of encouraging the purchase or rental of, or
10investment in, property, goods, or services or soliciting any
11type of monetary donation or contribution.
 
12    Section 10. Limitations on unsolicited junk mail.
13    (a) A for-profit corporation, association, limited
14liability company, partnership, or other legal entity shall
15not send or cause to be sent junk mail to a person residing in
16this State more than 2 times in a calendar year unless that
17resident responds to the junk mail by contacting the sender or
18affirmatively requests that the sender continues to send junk
19mail to the person's address.
20    (b) A not-for-profit organization shall not send or cause
21to be sent junk mail to a person residing in this State more
22than 6 times in a calendar year unless that resident responds

1to the junk mail by contacting the sender or affirmatively
2requests that the sender continues to send junk mail to the
3person's address.
 
4    Section 15. Enforcement by the Attorney General. A
5violation of any of the provisions of this Act is an unlawful
6practice under the Consumer Fraud and Deceptive Business
7Practices Act. All remedies, penalties, and authority granted
8to the Attorney General by that Act shall be available to him
9or her for the enforcement of this Act.
 
10    Section 90. The Consumer Fraud and Deceptive Business
11Practices Act is amended by adding Section 2HHHH as follows:

13    Sec. 2HHHH. Violations of the Paper Waste Reduction Act. A
14person who violates the Paper Waste Reduction Act commits an
15unlawful practice within the meaning of this Act.
