SYNOPSIS AS INTRODUCED:

    Amends the Recyclable Metal Purchase Registration Law. Provides that provisions prohibiting the sale of certain recyclable metal materials shall not apply if the seller produces written documentation reasonably demonstrating that the seller is the owner of the recyclable metal material or is authorized to sell the recyclable metal material on behalf of the owner. Provides that the recyclable metal dealer shall copy the documentation provided by the seller and maintain the copy of the documentation along with the purchase records. Provides that the sale of a detached catalytic converter may occur at the fixed business address of the seller or of the recyclable metal dealer (rather than at the fixed business address of the licensed recyclable metal dealer). Changes references from "licensed recyclable metal dealer" to "recyclable metal dealer".

1    AN ACT concerning business.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Recyclable Metal Purchase Registration Law
5is amended by changing Sections 4.1 and 4.4 as follows:
 
6    (815 ILCS 325/4.1)
7    Sec. 4.1. Restricted purchases.
8    (a) It is a violation of this Act for any person to
9possess, purchase, attempt to purchase, sell or attempt to
10sell, or for any recyclable metal dealer to purchase or
11attempt to purchase, any of the following:
12        (1) materials that are clearly marked as property
13    belonging to a business or someone else other than the
14    seller;
15        (2) property associated with use by governments,
16    utilities, or railroads including, but not limited to,
17    guardrails, manhole covers, electric transmission and
18    distribution equipment, including transformers, grounding
19    straps, wires or poles, historical markers, street signs,
20    traffic signs, sewer grates, or any rail, switch
21    component, spike, angle bar, tie plate, or bolt of the
22    type used in constructing railroad track;
23        (3) cemetery plaques or ornaments; or

1        (4) any catalytic converter or its contents not
2    attached to a motor vehicle at the time of the transaction
3    unless the seller is licensed as an automotive parts
4    recycler or scrap processor.
5    (b) (Blank).
6    (c) This Section shall not apply if the seller produces
7written documentation reasonably demonstrating that the seller
8is the owner of the recyclable metal material or is authorized
9to sell the recyclable metal material on behalf of the owner.
10The recyclable metal dealer shall copy the documentation
11provided by the seller and maintain the copy of the
12documentation along with the purchase records required under
13Section 3.

16    Sec. 4.4. Purchase of a catalytic converter or its
17contents.
18    (a) It is unlawful for any person to purchase or otherwise
19acquire a used, detached catalytic converter or any nonferrous
20part thereof unless all of the following apply:
21        (1) the person is a licensed recyclable metal dealer;
22        (2) the sale or purchase occurs at the fixed business
23    address of the seller or of the a licensed recyclable
24    metal dealer that is a party to the transaction; and
25        (3) the purchaser has maintained the information

1    required under Section 3 of the Recyclable Metal Purchase
2    Registration Law.
3    (b) A recyclable metal dealer shall not pay cash in
4payment for any catalytic converter or its contents having a
5value of $100 or more.
