AMENDMENT TO SENATE BILL 1740

2    AMENDMENT NO. ______. Amend Senate Bill 1740 as follows:
 
3on page 2, line 25, by deleting ", for those grants in excess
4of $25,000,"; and
 
5on page 4, line 14, after "10-17a," by inserting "10-20.9a,";
6and
 
7on page 4, line 15, by deleting "14-8.03,"; and
 
8on page 45, immediately below line 14, by inserting the
9following:
 
10    "(105 ILCS 5/10-20.9a)  (from Ch. 122, par. 10-20.9a)
11    Sec. 10-20.9a. Final grade; promotion.
12    (a) Teachers shall administer the approved marking system
13or other approved means of evaluating pupil progress. The

1teacher shall maintain the responsibility and right to
2determine grades and other evaluations of students within the
3grading policies of the district based upon his or her
4professional judgment of available criteria pertinent to any
5given subject area or activity for which he or she is
6responsible. District policy shall provide the procedure and
7reasons by and for which a grade may be changed; provided that
8no grade or evaluation shall be changed without notification
9to the teacher concerning the nature and reasons for such
10change. If such a change is made, the person making the change
11shall assume such responsibility for determining the grade or
12evaluation, and shall initial such change.
13    (b) School districts shall not promote students to the
14next higher grade level based upon age or any other social
15reasons not related to the academic performance of the
16students. On or before September 1, 1998, school boards shall
17adopt and enforce a policy on promotion as they deem necessary
18to ensure that students meet local goals and objectives and
19can perform at the expected grade level prior to promotion.
20Decisions to promote or retain students in any classes shall
21be based on successful completion of the curriculum,
22attendance, performance based on the assessments required
23under Section 2-3.64a-5 of this Code, the Iowa Test of Basic
24Skills, or other testing or any other criteria established by
25the school board. Students determined by the local district to
26not qualify for promotion to the next higher grade shall be

1provided remedial assistance, which may include, but shall not
2be limited to, a summer bridge program of no less than 90
3hours, tutorial sessions, increased or concentrated
4instructional time, modifications to instructional materials,
5and retention in grade.
6    (c) (Blank). No public high school of a school district
7shall withhold a student's grades, transcripts, or diploma
8because of an unpaid balance on the student's school account.
9    At the end of each school year, the school district shall
10catalogue and report to the State Board of Education the total
11amount that remains unpaid by students due to the prohibition
12under this subsection (c).
13    (d) (Blank). On and after 3 years from the effective date
14of this amendatory Act of the 102nd General Assembly,
15subsection (c) is inoperative.
