SYNOPSIS AS INTRODUCED:

Amends the Fair Patient Billing Act. Removes language providing that a hospital shall provide an itemized bill upon request. Provides instead that the hospital shall provide notice that the patient will be given an itemized statement of charges for inpatient and outpatient services rendered by the hospital unless the patient chooses to opt out of receiving such statement. Allows the itemized statement to be provided in an electronic format. Requires the information regarding the patient's choice to opt out to be prominent, clearly labeled, and provided to the patient before signing any documents relating to itemized billing. Prohibits a patient from being under the influence of any anesthetic or drug that inhibits mental performance when given the documents. Provides that the hospital's failure to comply with the requirements constitutes an unlawful practice under the Consumer Fraud and Deceptive Business Practices Act. Makes a corresponding change in the Consumer Fraud and Deceptive Business Practices Act.

A BILL FOR

AN ACT concerning regulation.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Fair Patient Billing Act is amended by changing Section 20 as follows:

(210 ILCS 88/20)

Sec. 20. Bill information. If a hospital bills a patient for health care services, the hospital shall provide with its bill the following information:

(1) the date or dates that health care services were provided to the patient;

(2) a brief description of the hospital services;

(3) the amount owed for hospital services;

(4) hospital contact information for addressing billing inquiries;

(5) a statement regarding how an uninsured patient may apply for consideration under the hospital's financial assistance policy on or with each hospital bill sent to an uninsured patient; and

(6) notice that the patient will be given an itemized statement of charges for inpatient and outpatient services rendered by the hospital unless the patient chooses to opt out of receiving such a statement may obtain an itemized bill upon request.

If a hospital bills a patient, then the hospital must provide an itemized statement of charges for the inpatient and outpatient services rendered by the hospital unless the patient opts out of receiving such a statement upon receiving a request from the patient. The itemized statement of charges may be provided in an electronic format at the discretion of the hospital unless the patient requests a physical copy of the statement of charges, which shall be provided upon request.

Information regarding the patient's choice to opt out shall be prominent, clearly labeled, and provided to the patient before signing any documents relating to itemized billing. The patient shall not be under the influence of any anesthetic or drug that inhibits mental performance when given the documents.

The hospital's failure to comply with the requirements of this Section constitutes an unlawful practice under the Consumer Fraud and Deceptive Business Practices Act.

Section 10. The Consumer Fraud and Deceptive Business Practices Act is amended by changing Section 2Z as follows:

Sec. 2Z. Violations of other Acts. Any person who knowingly violates the Automotive Repair Act, the Automotive Collision Repair Act, the Home Repair and Remodeling Act, the Dance Studio Act, the Physical Fitness Services Act, the Hearing Instrument Consumer Protection Act, the Illinois Union Label Act, the Installment Sales Contract Act, the Job Referral and Job Listing Services Consumer Protection Act, the Travel Promotion Consumer Protection Act, the Credit Services Organizations Act, the Automatic Telephone Dialers Act, the Pay-Per-Call Services Consumer Protection Act, the Telephone Solicitations Act, the Illinois Funeral or Burial Funds Act, the Cemetery Oversight Act, the Cemetery Care Act, the Safe and Hygienic Bed Act, the Illinois Pre-Need Cemetery Sales Act, the High Risk Home Loan Act, the Payday Loan Reform Act, the Predatory Loan Prevention Act, the Mortgage Rescue Fraud Act, subsection (a) or (b) of Section 3-10 of the Cigarette Tax Act, subsection (a) or (b) of Section 3-10 of the Cigarette Use Tax Act, the Electronic Mail Act, the Internet Caller Identification Act, paragraph (6) of subsection (k) of Section 6-305 of the Illinois Vehicle Code, Section 11-1431, 18d-115, 18d-120, 18d-125, 18d-135, 18d-150, or 18d-153 of the Illinois Vehicle Code, Article 3 of the Residential Real Property Disclosure Act, the Automatic Contract Renewal Act, the Reverse Mortgage Act, Section 25 of the Youth Mental Health Protection Act, the Personal Information Protection Act, or the Student Online Personal Protection Act, or Section 20 of the Fair Patient Billing Act commits an unlawful practice within the meaning of this Act.
