SYNOPSIS AS INTRODUCED:
 
615 ILCS 90/7.2  from Ch. 19, par. 1209

    Amends the Fox Waterway Agency Act. Removes language providing that the Fox Waterway Agency shall not have the authority to impose any property tax. Allows the board of directors to levy and collect a general property tax on any property within the corporate limits of the Agency for the purpose of paying the cost of operating and maintaining the waterway and any other corporate expenses of the Agency.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Fox Waterway Agency Act is amended by
5changing Section 7.2 as follows:
 
6    (615 ILCS 90/7.2)  (from Ch. 19, par. 1209)
7    Sec. 7.2. The Agency may charge reasonable user fees for
8recreational and commercial boating, and has the authority to
9issue revenue bonds and to borrow funds from any financial
10lending institution, but shall not have the authority to
11impose any property tax. The Agency shall devise a schedule of
12user fees. The Agency shall conduct public hearings before
13establishing or changing user fees or soliciting the issuance
14of revenue bonds or the borrowing of funds. The Agency may
15issue stickers as evidence of the payment of user fees. The
16Agency may impose a civil penalty on persons who knowingly use
17the waterway without paying a required user fee in an amount
18not exceeding $500 for each violation. Such civil penalty may
19be recovered by the Agency in a civil action.
20    The Agency may also sell its dredging materials from the
21waterway as reclaimed topsoil.
22    At least 75% of the gross income collected under this
23Section shall be used exclusively for projects designed to

1maintain and improve the waterway. Such projects may include,
2but are not limited to, dredging, site acquisition for silt
3deposit, water safety, and water quality projects. Any funds
4which have not been expended by the end of a fiscal year may be
5accumulated in a revolving fund.
6    The Board may levy and collect a general property tax on
7any property within the corporate limits of the Agency for the
8purpose of paying the cost of operating and maintaining the
9waterway and any other corporate expenses of the Agency. The
10tax shall be authorized by a majority vote of the Board.
