SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Illinois Health and Safety in Cosmetology and Barbering Products Disclosure Act. Requires the posting of health risk information and the provision of a pamphlet, with specific requirements. Requires the Department of Public Health to develop a posted notice and pamphlet that comply with the Act and make them available for download. Provides that the Department is responsible for monitoring compliance and making inspections. Denotes a petty offense as a penalty for violation. Exempts individuals or businesses who do not sell or use chemical products. Defines terms.

1    AN ACT concerning health.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the
5Illinois Health and Safety in Cosmetology and Barbering
6Products Disclosure Act.
 
7    Section 5. Definitions. In this Act:
8    "Barber" means any person licensed under the laws of
9Illinois to practice barbering. "Barber" includes "licensed
10barber" as that term is used in the Barber, Cosmetology,
11Esthetics, Hair Braiding, and Nail Technology Act of 1985.
12    "Beauty supply retailer" means any business, including
13beauty salons, barber shops, or retail stores, that sells
14personal care and beauty products, including hair care,
15skincare, and makeup products.
16    "Chemical products" means any cosmetic, hair care,
17skincare, or personal grooming product used or sold by
18cosmetologists, barbers, or beauty supply retailers that
19contains ingredients known to have potential health risks such
20as carcinogenic, reproductive, or endocrine-disrupting
21effects.
22    "Cosmetologist" means any person licensed under the laws
23of Illinois to practice cosmetology, esthetics, or nail

1technology. "Cosmetologist" includes "licensed
2cosmetologist", "licensed esthetician", and "licensed nail
3technician" as those terms are used in the Barber,
4Cosmetology, Esthetics, Hair Braiding, and Nail Technology Act
5of 1985.
6    "Health risks" means risks to human health that include,
7but are not limited to, cancer, birth defects, reproductive
8harm, skin irritation, endocrine disruption, and other
9long-term health effects as identified by the U.S.
10Environmental Protection Agency, the U.S. Food and Drug
11Administration, or other authoritative health organizations.
 
12    Section 10. Posting of health risk information.
13    (a) All cosmetologists, barbers, and beauty supply
14retailers operating within the State of Illinois shall display
15a visible and easily readable notice in a prominent location
16within their business establishment that provides information
17on the potential health risks associated with the chemical
18products contained in the products they use or sell.
19    (b) The posted notice must include, at a minimum, the
20following:
21        (1) A statement that some products may contain
22    chemicals known to cause harm to human health.
23        (2) A list of common chemicals or ingredients found in
24    beauty and personal care products, including formaldehyde,
25    phthalates, parabens, and toluene, and their associated

1    health risks.
2        (3) A reference to resources where customers can
3    access more detailed information, including the website of
4    the Illinois Department of Public Health and other
5    relevant health organizations.
6    (c) The posted notice must be at least 11 inches by 14
7inches in size, placed in a visible location near the
8reception area or other commonly accessed areas of the
9business where customers can easily read the notice. The font
10size must be large enough to be legible from a reasonable
11distance.
12    (d) The Illinois Department of Public Health shall develop
13a posted notice that complies with this Section and make that
14notice available for download as a printable document on its
15Internet website.
 
16    Section 15. Pamphlet distribution.
17    (a) At the point of sale, all cosmetologists, barbers, and
18beauty supply retailers must provide each customer with a
19pamphlet containing the same information detailed in Section
2010. This pamphlet must be provided to customers for any
21service involving the use of beauty or personal care products.
22    (b) The pamphlet must include:
23        (1) A brief description of the potential health risks
24    associated with chemicals commonly used in beauty
25    products.

1        (2) A list of specific ingredients commonly found in
2    products such as hair relaxers, hair dyes, nail polishes,
3    and other personal care items, along with their known or
4    suspected health effects.
5        (3) Contact information for the Illinois Department of
6    Public Health and other trusted resources for additional
7    information.
8    (c) The Department of Public Health shall develop a
9pamphlet that complies with this Section and make that
10pamphlet available for download as a printable document on its
11Internet website.
 
12    Section 20. Compliance and enforcement.
13    (a) The Illinois Department of Public Health shall be
14responsible for monitoring compliance with this Act. The
15Department may inspect beauty supply retailers, barbershops,
16and salons to ensure that health risk information is properly
17posted and pamphlets are distributed in accordance with this
18Act.
19    (b) A cosmetologist, barber, or beauty supply retailer
20found to be in violation of the provisions of this Act is
21guilty of a petty offense.
22    (c) The requirements of this Act do not apply to
23individuals or businesses who do not sell or use chemical
24products in the course of their operation.
