SYNOPSIS AS INTRODUCED:
 
New Act

    Creates the Access and Functional Needs Individual Registry Act. Directs the Secretary of State to establish the access and functional needs individual registry in consultation with local emergency management agencies, with certain requirements. Provides for privacy and security and the responsibilities of public safety partners. Requires annual reporting by the Secretary of State to the Governor and the General Assembly. Provides for funding and rulemaking. Declares a purpose and defines terms. Effective immediately.

1    AN ACT concerning safety.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the Access
5and Functional Needs Individual Registry Act.
 
6    Section 5. Purpose. The purpose of this Act is to
7establish a statewide voluntary registry for access and
8functional needs individuals, in order to support effective
9planning and response efforts by public safety partners during
10emergencies and disasters.
 
11    Section 10. Definitions. In this Act:
12    "Access and functional needs individual" or "AFN
13individual" means an individual who may require additional
14assistance before, during, and after an emergency due to
15physical, sensory, mental health, cognitive, or intellectual
16disabilities; limitations related to age; chronic health
17conditions; or reliance on assistive technology, a service
18animal, or transportation assistance.
19    "Public safety partners" means agencies and organizations
20responsible for emergency management, including law
21enforcement, fire services, emergency medical services,
22emergency management agencies, and public health departments.

1    "Registry" means the access and functional needs
2individual registry, the voluntary statewide database that
3collects and maintains information on AFN individuals,
4accessible to public safety partners during emergency
5planning, response, and recovery, established by the Secretary
6of State under this Act or rules adopted under this Act.
 
7    Section 15. Establishment of the Registry.
8    (a) The Secretary of State, in consultation with local
9emergency management agencies, shall establish and maintain a
10centralized, secure, and voluntary statewide access and
11functional needs individual registry.
12    (b) The registry shall collect relevant information to
13identify AFN individuals' specific needs in emergency
14situations, including, but not limited to:
15        (1) the AFN individual's name;
16        (2) the contact information for the AFN individual;
17        (3) the primary residence of the AFN individual;
18        (4) the type of assistance needed by the AFN
19    individual, such as mobility assistance, medical
20    equipment, or transportation support;
21        (5) the emergency contact information for the AFN
22    individual; and
23        (6) the consent by the AFN individual for data sharing
24    with public safety partners.
25    (c) AFN individuals may voluntarily enroll in the registry

1through online platforms, local emergency management offices,
2healthcare providers, or non-governmental organizations. The
3Secretary of State may enter into agreements to implement this
4Section.
 
5    Section 20. Privacy and security.
6    (a) The information in the registry shall be confidential
7and used solely for emergency planning, response, and
8recovery.
9    (b) Access to the registry shall be limited to authorized
10personnel within the Secretary of State, local emergency
11management agencies, and other designated public safety
12partners.
13    (c) Strict data security measures shall be implemented to
14protect personal information from unauthorized access,
15breaches, or misuse.
16    (d) Participants may opt out of the registry or update
17their information at any time.
 
18    Section 25. Responsibilities of public safety partners.
19    (a) Public safety partners shall use the registry to
20enhance preparedness and response efforts for AFN individuals
21by:
22        (1) integrating registry data into local emergency
23    operations plans;
24        (2) coordinating with healthcare providers and support

1    services to address AFN needs during evacuations,
2    sheltering, and disaster recovery; and
3        (3) conducting outreach and education to raise
4    awareness of the registry.
5    (b) Local emergency management agencies shall be
6responsible for promoting the registry within their
7jurisdictions and collaborating with community organizations,
8including those serving individuals with disabilities,
9seniors, and other vulnerable populations.
 
10    Section 30. Reporting requirements. On or before January 1
11of each year, beginning January 1, 2026, the Secretary of
12State shall submit an annual report to the Governor and the
13General Assembly on the operation of the Access and Functional
14Needs Individual Registry, including participation rates,
15outreach efforts, and any recommendations for improvements.
 
16    Section 35. Funding; rulemaking.
17    (a) The establishment and maintenance of the registry
18shall be funded through appropriations from the State's
19General Revenue Fund, federal grants, other sources designated
20for public safety, or any combination of those sources.
21    (b) The Secretary of State shall adopt rules implementing
22this Act.
 
23    Section 99. Effective date. This Act takes effect upon
24becoming law.
