AMENDMENT TO HOUSE BILL 1270

2    AMENDMENT NO. ______. Amend House Bill 1270 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Department of Professional Regulation Law
5of the Civil Administrative Code of Illinois is amended by
6changing Section 2105-17 as follows:
 
7    (20 ILCS 2105/2105-17)
8    Sec. 2105-17. Volunteer license status licenses.
9    (a) For the purposes of this Section:
10    "Health care professional" means a physician licensed
11under the Medical Practice Act of 1987, a dentist licensed
12under the Illinois Dental Practice Act, an optometrist
13licensed under the Illinois Optometric Practice Act of 1987, a
14physician assistant licensed under the Physician Assistant
15Practice Act of 1987, and a nurse or advanced practice
16registered nurse licensed under the Nurse Practice Act. The

1Department may expand this definition by rule.
2    "Volunteer practice" means the practice of a licensed
3health care professional for the benefit of an individual or
4the public and without compensation for the health care
5services provided.
6    (b) A The Department may grant a volunteer license to a
7health care professional may submit an application to the
8Department to place the health care professional's license on
9volunteer status if the health care professional who:
10        (1) holds an active license that is not currently
11    subject to discipline or under investigation by the
12    Department meets all requirements of the State licensing
13    Act that applies to his or her health care profession and
14    the rules adopted under the Act; and
15        (2) agrees to engage only in the volunteer practice of
16    his or her health care profession in a free medical
17    clinic, as defined in the Good Samaritan Act, or in a
18    public health clinic, as defined in Section 6-101 of the
19    Local Governmental and Governmental Employees Tort
20    Immunities Act, and to not practice for compensation.
21    (c) An application submitted under this Section shall not
22require payment of a fee. A license in volunteer status may be
23renewed in the same manner, at the same time, and with the same
24conditions as an active license, except that a renewal fee
25shall not be required. A volunteer license shall be granted in
26accordance with the licensing Act that applies to the health

1care professional's given health care profession, and the
2licensure fee shall be set by rule in accordance with
3subsection (f).
4    (d) A health care professional whose license is in
5volunteer status may request the Department to change the
6status to active as long as the request is made during the same
7renewal period in which the license was previously active or
8the health care professional renews the license in the same
9manner and at the same time with the same conditions as an
10active license. No health care professional shall hold a
11non-volunteer license in a health care profession and a
12volunteer license in that profession at the same time. In the
13event that the health care professional obtains a volunteer
14license in the profession for which he or she holds a
15non-volunteer license, that non-volunteer license shall
16automatically be placed in inactive status. In the event that
17a health care professional obtains a non-volunteer license in
18the profession for which he or she holds a volunteer license,
19the volunteer license shall be placed in inactive status.
20Practicing on a license in volunteer status that does not meet
21the requirements of subsection (b) an expired volunteer
22license constitutes the unlicensed practice of the health care
23professional's profession.
24    (e) Nothing in this Section shall be construed to waive or
25modify any statute, rule, or regulation concerning the
26licensure or practice of any health care profession. A health

1care professional whose license is in volunteer status who
2holds a volunteer license shall be subject to all statutes,
3rules, and regulations governing his or her profession, except
4as provided in this Section. The Department shall waive the
5licensure fee for the first 500 volunteer licenses issued and
6may by rule provide for a fee waiver or fee reduction that
7shall apply to all licenses issued after the initial 500.
8    (f) The Department may adopt rules for the administration
9of this Section. shall determine by rule the total number of
10volunteer licenses to be issued. The Department shall file
11proposed rules implementing this Section within 6 months after
12the effective date of this amendatory Act of the 98th General
13Assembly.
