SYNOPSIS AS INTRODUCED:
 
20 ILCS 2105/2105-17

    Amends the Department of Professional Regulation Law of the Civil Administrative Code of Illinois. In a provision concerning the requirements that a health care professional must meet before he or she can have his or her license placed on volunteer status (rather than being granted a volunteer license), provides that a health care professional must possess an active license that is not currently subject to discipline or under investigation by the Department of Financial and Professional Regulation (rather than satisfaction of all requirements of the State licensing Act that applies to his or her health care profession and the rules adopted under the Act). Removes the volunteer licensure fee and removes references to volunteer licenses. Provides that a health care professional whose license is in volunteer status may request that the Department change the status of the license to active as long as the request for the change is made during the same renewal period in which the license was previously active or the license is renewed in the same manner, at the same time, and with the same conditions as an active license. Provides that a health care professional who holds an active license that was previously a volunteer license is subject to the requirements of the State licensing Act that applies to his or her health care profession and the rules adopted under the relevant Act. Provides that the Department may adopt rules for the administration of the provisions regarding volunteer licenses (rather than determining by rule the total number of volunteer licenses to be issued). Makes conforming and other changes.

1    AN ACT concerning State government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Department of Professional Regulation Law
5of the Civil Administrative Code of Illinois is amended by
6changing Section 2105-17 as follows:
 
7    (20 ILCS 2105/2105-17)
8    Sec. 2105-17. Volunteer license status licenses.
9    (a) For the purposes of this Section:
10    "Health care professional" means a physician licensed
11under the Medical Practice Act of 1987, a dentist licensed
12under the Illinois Dental Practice Act, an optometrist
13licensed under the Illinois Optometric Practice Act of 1987, a
14physician assistant licensed under the Physician Assistant
15Practice Act of 1987, and a nurse or advanced practice
16registered nurse licensed under the Nurse Practice Act. The
17Department may expand this definition by rule.
18    "Volunteer practice" means the practice of a licensed
19health care professional for the benefit of an individual or
20the public and without compensation for the health care
21services provided.
22    (b) A The Department may grant a volunteer license to a
23health care professional may submit an application to the

1Department to place his or her license on volunteer status if
2the health care professional who:
3        (1) holds an active license that is not currently
4    subject to discipline or under investigation by the
5    Department meets all requirements of the State licensing
6    Act that applies to his or her health care profession and
7    the rules adopted under the Act; and
8        (2) agrees to engage in the volunteer practice of his
9    or her health care profession in a free medical clinic, as
10    defined in the Good Samaritan Act, or in a public health
11    clinic, as defined in Section 6-101 of the Local
12    Governmental and Governmental Employees Tort Immunities
13    Act, and to not practice for compensation.
14    (c) An application submitted under this Section shall not
15require payment of a fee. A license in volunteer status may be
16renewed in the same manner, at the same time, and with the same
17conditions as an active license, except that a renewal fee
18shall not be required. A volunteer license shall be granted in
19accordance with the licensing Act that applies to the health
20care professional's given health care profession, and the
21licensure fee shall be set by rule in accordance with
22subsection (f).
23    (d) A health care professional whose license is in
24volunteer status may request the Department to change the
25status to active as long as the request for the change is made
26during the same renewal period in which the license was

1previously active or the license is renewed in the same
2manner, at the same time, and with the same conditions as an
3active license. A health care professional who holds an active
4license that was previously a volunteer license is subject to
5the requirements of the State licensing Act that applies to
6his or her health care profession and the rules adopted under
7the relevant Act. No health care professional shall hold a
8non-volunteer license in a health care profession and a
9volunteer license in that profession at the same time. In the
10event that the health care professional obtains a volunteer
11license in the profession for which he or she holds a
12non-volunteer license, that non-volunteer license shall
13automatically be placed in inactive status. In the event that
14a health care professional obtains a non-volunteer license in
15the profession for which he or she holds a volunteer license,
16the volunteer license shall be placed in inactive status.
17Practicing on a license in volunteer status that does not meet
18the requirements of subsection (b) an expired volunteer
19license constitutes the unlicensed practice of the health care
20professional's profession.
21    (e) Nothing in this Section shall be construed to waive or
22modify any statute, rule, or regulation concerning the
23licensure or practice of any health care profession. A health
24care professional whose license is in volunteer status who
25holds a volunteer license shall be subject to all statutes,
26rules, and regulations governing his or her profession, except

1as provided in this Section. The Department shall waive the
2licensure fee for the first 500 volunteer licenses issued and
3may by rule provide for a fee waiver or fee reduction that
4shall apply to all licenses issued after the initial 500.
5    (f) The Department may adopt rules for the administration
6of this Section. shall determine by rule the total number of
7volunteer licenses to be issued. The Department shall file
8proposed rules implementing this Section within 6 months after
9the effective date of this amendatory Act of the 98th General
10Assembly.
