    Amends the Medical Practice Act of 1987. Provides that the rules adopted by the Department of Financial and Professional Regulation to implement provisions concerning the licensure of international medical graduate physicians includes emergency rules. Requires the emergency rules to be adopted by no later than March 1, 2025. Amends the Illinois Administrative Procedure Act to make conforming changes. Effective immediately.

1    AN ACT concerning regulation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Administrative Procedure Act is
5amended by adding Section 5-45.65 as follows:
 
6    (5 ILCS 100/5-45.65 new)
7    Sec. 5-45.65. Emergency rulemaking; Medical Practice Act
8of 1987. To provide for the expeditious and timely
9implementation of Section 15.5 of the Medical Practice Act of
101987, emergency rules implementing Section 15.5 of the Medical
11Practice Act of 1987 may be adopted in accordance with Section
125-45 by the Department of Financial and Professional
13Regulation. The adoption of emergency rules authorized by
14Section 5-45 and this Section is deemed to be necessary for the
15public interest, safety, and welfare.
16    This Section is repealed one year after the effective date
17of this amendatory Act of the 103rd General Assembly.
 
18    Section 10. The Medical Practice Act of 1987 is amended by
19changing Section 15.5 as follows:

21    Sec. 15.5. International medical graduate physicians;

1licensure. After January 1, 2025, an international medical
2graduate physician may apply to the Department for a limited
3license. The Department shall:
4        (1) establish qualifications and application fees for
5    the limited licensure of international medical graduate
6    physicians;
7        (2) provide a pathway to full licensure for limited
8    license holders after the licensee successfully completes
9    a supervision period and satisfies other qualifications as
10    established by the Department;
11        (3) after January 1, 2026, establish, in collaboration
12    with the Department of Public Health and the Governor's
13    Office of New Americans, a clinical readiness program to
14    provide direct services to international medical graduate
15    physicians seeking to reestablish their medical careers
16    and obtain residency in this State. The establishment and
17    administration of the clinical readiness program for
18    international medical graduate physicians shall be subject
19    to appropriation. The clinical readiness program shall be
20    implemented pursuant to a New American Plan developed by
21    the Department in accordance with the Governor's Office of
22    New Americans Act and administered by the licensing
23    liaison for international applicants under Section
24    2105-405 of the Department of Professional Regulation Law
25    of the Civil Administrative Code of Illinois. The
26    Department may, in its discretion, contract with a vendor

1    or with another State agency, through an intergovernmental
2    agreement, to assist in the implementation and
3    administration of this program; and
4        (4) adopt rules, including emergency rules, as may be
5    necessary for the implementation, administration, and
6    enforcement of this Section. The emergency rules adopted
7    under this paragraph (4) must be adopted by no later than
8    March 1, 2025.

10    Section 99. Effective date. This Act takes effect upon
11becoming law.
