AMENDMENT TO HOUSE BILL 5397

2    AMENDMENT NO. ______. Amend House Bill 5397 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Illinois Petroleum Education and Marketing
5Act is amended by changing Section 10 as follows:
 
6    (225 ILCS 728/10)
7    (Section scheduled to be repealed on January 1, 2028)
8    Sec. 10. Illinois Petroleum Resources Board.
9    (a) There is hereby created the Illinois Petroleum
10Resources Board, which shall be subject to the provisions of
11the Regulatory Sunset Act. The purpose of the Board is to
12coordinate a program designed to demonstrate to the general
13public the importance of the Illinois oil and gas exploration
14and production industry, to encourage the wise and efficient
15use of energy, to promote environmentally sound production
16methods and technologies, to develop existing supplies of

1State oil and gas resources, to support research and
2educational activities concerning the oil and gas exploration
3and production industry, and to support oilfield environmental
4remediation and restoration activities.
5    (b) The Board shall be composed of 12 members to be
6appointed as follows:
7        (1) Through December 31, 2006, the Governor shall make
8    appointments from a list of names submitted by qualified
9    producer associations, of which 10 shall be oil and gas
10    producers.
11        (2) Beginning January 1, 2007 and through the
12    effective date of this amendatory Act of the 103rd General
13    Assembly, all appointments shall be made by the qualified
14    producer associations.
15        (3) Beginning on the effective date of this amendatory
16    Act of the 103rd General Assembly, the Director of Natural
17    Resources shall make appointments to the Board, of which
18    10 shall be oil and gas producers. The Director may make
19    these appointments based on names submitted to the
20    Department of Natural Resources by oil and gas producers
21    in the State.
22    (c) A member of the Board shall:
23        (1) be at least 25 years of age;
24        (2) be a resident of the State of Illinois; and
25        (3) have at least 5 years of active experience in the
26    oil industry.

1    (d) Members shall serve for a term of 3 years, except that
2of the initial appointments, 4 members shall serve for one
3year, 4 members for 2 years, and 4 members for 3 years.
4    (e) Vacancies shall be filled for the unexpired term of
5office in the same manner as the original appointment.
6    (f) The Board shall, at its first meeting, elect one of its
7members as chairperson, who shall preside over meetings of the
8Board and perform other duties that may be required by the
9Board. The first meeting of the Board shall be called by the
10Governor.
11    (g) No member of the Board shall receive a salary or
12reimbursement for duties performed as a member of the Board,
13except that members are eligible to receive reimbursement for
14travel expenses incurred in the performance of Board duties.

16    Section 99. Effective date. This Act takes effect upon
17becoming law.".
