3 | | represented in the General Assembly:

4 | | Section 5. The Department of Agriculture Law of the Civil |
5 | | Administrative
Code of Illinois is amended by adding Section |
6 | | 205-455 as follows: |
7 | | (20 ILCS 205/205-455 new) |
8 | | Sec. 205-455. Grants to special access food providers. |
9 | | (a) Beginning on July 1, 2023, subject to appropriation, |
10 | | the Department shall award grants to special access food |
11 | | providers in the State. The amount of the grant may not exceed |
12 | | the sum or 15% of the special access food provider's basis in |
13 | | the grocery store, plus 10% of the renovation expenditures |
14 | | incurred by the special access food provider. |
15 | | (b) As used in this Section: |
16 | | "Food desert" means any census tract that meets the |
17 | | following criteria: |
18 | | (1) if the census tract is located in a metropolitan |
19 | | area, then not less than 500 people or 33% of the |
20 | | population of the census tract, whichever is less, reside |
21 | | more than one mile from a grocery store; or |
22 | | (2) if the census tract is located in a |
23 | | nonmetropolitan area, then not less than 500 people or 33% |
