1 | | (d) of Section 15 of this Act unless the off-highway vehicle
|
2 | | displays an off-highway vehicle trails public access sticker |
3 | | in a manner prescribed
by the Department by rule. |
4 | | (c) An off-highway vehicle does not need an off-highway |
5 | | vehicle trails public access sticker if the
off-highway |
6 | | vehicle is used on private land or if the off-highway vehicle |
7 | | is
owned by the State, the federal government, or a unit of |
8 | | local government. |
9 | | (d) The Department shall issue an off-highway vehicle |
10 | | trails public access sticker and shall charge
the following |
11 | | fees: |
12 | | (1) $30 for 3 years for individuals; |
13 | | (2) $50 for 3 years for rental units; |
14 | | (3) $75 for 3 years for dealer and manufacturer |
15 | | demonstrations and
research; |
16 | | (4) $50 for 3 years for an all-terrain vehicle or |
17 | | off-highway motorcycle
used for production agriculture, as |
18 | | defined in Section 3-821 of the Illinois
Vehicle Code; |
19 | | (5) $50 for 3 years for residents of a State other than |
20 | | Illinois that
does not have a reciprocal agreement with |
21 | | the Department, under
subsection (e) of this Section; and |
22 | | (6) $50 for 3 years for an all-terrain vehicle or |
23 | | off-highway motorcycle
that does not have a title. |
24 | | (d-5) The Department, by administrative rule, may make |
25 | | replacement stickers available
at a reduced cost. The fees for |
26 | | public access stickers shall be deposited
as follows: into the |

1 | | Off-Highway
Vehicle Trails Fund |
2 | | (1) $5 from the sale of each off-highway vehicle |
3 | | trails public access sticker shall be deposited into the |
4 | | Tick Research, Education, and Evaluation (TREE) Fund, |
5 | | which is created as a special fund in the State treasury. |
6 | | Moneys deposited in the Tick Research, Education, and |
7 | | Evaluation (TREE) Fund shall be paid as grants to the |
8 | | Illinois Lyme Association for the ordinary and contingent |
9 | | expenses associated with tick research, education, and |
10 | | evaluation; and |
11 | | (2) the remainder of the fees for public access |
12 | | stickers shall be deposited into the Off-Highway Vehicle |
13 | | Trails Fund to be used for improvements to Illinois State |
14 | | Parks . |
15 | | (e) The Department may enter into reciprocal agreements |
16 | | with
other states that have a similar off-highway vehicle |
17 | | trails public access sticker
program to allow residents of |
18 | | those states to operate off-highway vehicles on
land or lands |
19 | | or waters in public off-highway vehicle parks paid for, |
20 | | operated,
or supported by the off-highway vehicle trails grant |
21 | | program established under subsection (d) of Section
15 of this |
22 | | Act without acquiring an off-highway vehicle trails public |
23 | | access sticker in this State
under subsection (b) of this |
24 | | Section. |
25 | | (f) The Department may license vendors to sell
off-highway |
26 | | vehicle trails public access stickers. Issuing fees may be set |

1 | | by
administrative rule. |
2 | | (g) Any person participating in an organized competitive |
3 | | event on land or
lands in
off-highway vehicle parks paid for, |
4 | | operated by, or supported by the grant
program
established in |
5 | | subsection (d) of Section 15 shall display the public access
|
6 | | sticker required
under subsection (b) of this Section or pay |
7 | | $5 per event. Fees collected under
this
subsection shall be |
8 | | deposited into the Off-Highway
Vehicle Trails Fund.
