Amends the Children with Disabilities Article of the School Code. Allows a provider of special education services to enter into a contract with a school district to create a small, customized program. Provide that the provider may choose to not enroll students from any surrounding school district regardless of whether the program is located within a public school building. Allows the school district to negotiate on price with the provider and shall receive full funding from the State Board of Education for students participating in the program. Provides that the school district shall assume control of the process relating to costs and rates instead of the Illinois Purchased Care Review Board and the licensure requirements of the Code do not apply to staff members of the program. Effective immediately.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The School Code is amended by adding Section |
5 | | 14-17 as follows: |
6 | | (105 ILCS 5/14-17 new) |
7 | | Sec. 14-17. Contract for program. |
8 | | (a) This Section applies notwithstanding any other law to |
9 | | the contrary. |
10 | | (b) A provider of special education services may enter |
11 | | into a contract with a school district to create a small, |
12 | | customized program. The provider may choose to not enroll |
13 | | students from any surrounding school district regardless of |
14 | | whether the program is located within a public school building |
15 | | in order for the contracting school district to control who is |
16 | | served within its school buildings and to address the needs of |
17 | | specific populations. |
18 | | (c) The school district may negotiate on price, including |
19 | | per diem expenses, with the provider and shall receive full |
20 | | funding from the State Board of Education for students |
21 | | participating in the program. The school district shall assume |
22 | | control of the process relating to costs and rates instead of |
23 | | the Illinois Purchased Care Review Board to allow the school |
