2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Board of Higher Education Act is amended by |
5 | | changing Section 13 as follows: |
6 | | (110 ILCS 205/13) |
7 | | Sec. 13. Leadership training for university board members. |
8 | | (a) The Board shall require every voting member of the |
9 | | governing board of a public university appointed for a term |
10 | | beginning after January 1, 2016 to complete a minimum of 4 |
11 | | hours of professional development leadership training covering |
12 | | topics that shall include, but are not limited to, public |
13 | | university and labor law, contract law, ethics, sexual violence |
14 | | on campus, financial oversight and accountability, audits, |
15 | | equity, student success, and fiduciary responsibilities of a |
16 | | member of a governing board within 2 years after beginning |
17 | | service and within every 2 years of service thereafter. |
18 | | (b) A public university shall maintain on its Internet |
19 | | website the names of all voting members of the governing board |
20 | | who have successfully completed the training. |
21 | | (c) Beginning after the effective date of this amendatory |
22 | | Act of the 99th General Assembly, by July 31 of each year, the |
23 | | chairperson of each governing board shall certify to the Board |

1 | | the number of hours of training that each member received |
2 | | during the preceding fiscal year. |
3 | | (d) If the certification indicates that a board member has |
4 | | not completed the training required under this Section, the |
5 | | Board shall send a notice to the Governor, the President of the |
6 | | Senate, the Minority Leader of the Senate, the Speaker of the |
7 | | House of Representatives, and the Minority Leader of the House |
8 | | of Representatives of that fact, and the governing board shall |
9 | | suspend the board member from continued service, at which |
10 | | point, the board member has 45 days to complete all training |
11 | | deemed incomplete as provided by the certification. Failure of |
12 | | the board member to complete the necessary training within this |
13 | | probationary period constitutes a resignation from and creates |
14 | | a vacancy in the governing board, to be filled as provided by |
15 | | law. |
16 | | (e) The training under this Section may be provided by the |
17 | | Board or by other qualified providers approved by the Board.

19 | | Section 10. The Public Community College Act is amended by |
20 | | changing Section 3-8.5 as follows: |

24 | | (a) This Section applies to all community college districts

1 | | with elected or appointed board trustees serving pursuant to |
2 | | this Article
who have been elected or appointed after the |
3 | | effective date of this
amendatory Act of the 99th General |
4 | | Assembly or appointed to
fill a vacancy of at least one year's |
5 | | duration of an elected
trustee after the effective date of this |
6 | | amendatory Act of the
99th General Assembly. |
7 | | (b) Every voting member of a board under subsection (a) of |
8 | | this Section shall
complete a minimum of 4 hours of |
9 | | professional development
leadership training covering topics |
10 | | that shall include, but are not limited to, open meetings law, |
11 | | community college and
labor law, freedom of information law,
|
12 | | contract law, ethics, sexual violence on campus, financial |
13 | | oversight and
accountability, audits, equity, student success, |
14 | | and fiduciary responsibilities of a
community college trustee |
15 | | during the first, third, and fifth
year of his or her term. The |
16 | | community college district shall
maintain on its Internet |
17 | | website, if any, the names of all
elected or appointed voting |
18 | | trustees of the board who have successfully
completed the |
19 | | training, as well as the names of all elected or appointed |
20 | | voting trustees of the board who have not successfully |
21 | | completed the training, as required under this Section. |
22 | | (c) The training under this Section may be provided by an
|
23 | | association established under this Code for the purpose of
|
24 | | training community college district board trustees or by other
|
25 | | qualified providers approved by the State Board, in
|
26 | | consultation with an association so established. |

1 | | (d) The board member shall certify completion of the
|
2 | | training required under this Section to the secretary of the
|
3 | | board. If a board member does not satisfy all requirements |
4 | | provided in subsection (b) of this Section or the certification |
5 | | indicates that a board member has
not completed the training, |
6 | | the secretary shall send a notice
to all elected or appointed |
7 | | members serving on the board and the president or acting
chief |
8 | | executive officer of the community college of that fact.
