2 | | AMENDMENT NO. ______. Amend Senate Bill 3190 by replacing |
3 | | everything after the enacting clause with the following:

4 | | "Section 5. The Dual Credit Quality Act is amended by |
5 | | changing Sections 15 and 20 and by adding Sections 16, 17, 18, |
6 | | 19, and 35 as follows: |
7 | | (110 ILCS 27/15)

8 | | Sec. 15. Student academic standing access, eligibility, |
9 | | and attainment .
|
10 | | (a) The Illinois Community College Board and the Board of |
11 | | Higher Education shall develop policies to permit multiple |
12 | | appropriate measures using differentiated assessment for |
13 | | granting eligibility for dual credit to students. The measures |
14 | | developed shall ensure that a student is prepared for any |
15 | | coursework in which the student enrolls. |
16 | | (b) Institutions may adopt policies to protect the academic |

1 | | standing of students who are not successful in dual credit |
2 | | courses, including, but not limited to, options for (i) late |
3 | | withdrawal from a course, or (ii) taking the course on a |
4 | | pass-fail basis, or both. All institutional policies relating |
5 | | to the academic standing of students enrolled in dual credit |
6 | | courses or the transfer of credit for dual credit courses must |
7 | | be made publicly available by the institution and provided to |
8 | | each student enrolled in dual credit courses offered by that |
9 | | institution.

11 | | (110 ILCS 27/16 new) |
12 | | Sec. 16. High school and community college partnership |
13 | | agreements; dual credit. A community college district shall, |
14 | | upon the request of a school district within the jurisdiction |
15 | | of the community college district, enter into a partnership |
16 | | agreement with the school district to offer dual credit |
17 | | coursework. |
18 | | A school district may offer any course identified in the |
19 | | Illinois Articulation Initiative General Education Core |
20 | | Curriculum package under the Illinois Articulation Initiative |
21 | | Act as a dual credit course on the campus of a high school of |
22 | | the school district and may use a high school instructor who |
23 | | has met the academic credential requirements under this Act to |
24 | | teach the dual credit course. |
25 | | The partnership agreement shall include all of the |

1 | | following: |
2 | | (1) The establishment of the school district's and the |
3 | | community college district's respective roles and |
4 | | responsibilities in providing the program and ensuring the |
5 | | quality and instructional rigor of the program. This must |
6 | | include an assurance that the community college district |
7 | | has appropriate academic control of the curriculum, |
8 | | consistent with any State or federal law and as required or |
9 | | negotiated with the Higher Learning Commission or other |
10 | | applicable accrediting agency. |
11 | | (2) The dual credit courses that the school district |
12 | | will offer its students and whether those courses will be |
13 | | offered on the high school or community college campus or |
14 | | through an online platform established by the Illinois |
15 | | Community College Board. |
16 | | (3) The establishment of academic criteria for |
17 | | granting eligibility for high school students to enroll in |
18 | | dual credit coursework. The academic criteria shall be |
19 | | evidence-based and shall include multiple appropriate |
20 | | measures to determine whether a student is prepared for any |
21 | | dual credit coursework in which the student enrolls. |
22 | | (4) The establishment of any limitations that the |
23 | | school district or community college district may put on |
24 | | course offerings due to availability of instructors, the |
25 | | availability of students for specific course offerings, or |
26 | | local board policy. |

1 | | (5) The requirement that the dual credit instructor |
2 | | meet the academic credential requirements to teach a dual |
3 | | credit course, consistent with paragraphs (1), (2), and (3) |
4 | | of Section 20 of this Act, but shall not be required to |
5 | | exceed those credentials. |
6 | | (6) The collaborative process and criteria by which the |
7 | | school district shall identify and recommend and the |
8 | | community college district shall review and approve high |
9 | | school instructors of dual credit courses taught on the |
10 | | campus of a high school. This provision shall require that |
11 | | the school district be responsible for hiring and |
12 | | compensating the instructor. |
13 | | (7) The requirement that a community college district |
14 | | take the appropriate steps to ensure that dual credit |
15 | | courses are equivalent to those courses offered at the |
16 | | community college in quality and rigor to qualify for |
17 | | college credit. The dual credit programs shall encompass |
18 | | the following characteristics: |
19 | | (A) Student learning outcomes expected for dual |
20 | | credit courses in General Education Core Curriculum |
21 | | courses and the professional and career and technical |
22 | | disciplines shall be the same as the student learning |
23 | | outcomes expected for the same courses taught on the |
24 | | postsecondary campus. |
25 | | (B) Course content, course delivery, and course |
26 | | rigor shall be evaluated by the community college chief |

1 | | academic officer or his or her designee, in |
2 | | consultation with the school district's superintendent |
3 | | or his or her designee. The evaluation shall be |
4 | | conducted in a manner that is consistent with the |
5 | | community college district's review and evaluation |
6 | | policy and procedures for on-campus adjunct faculty, |
7 | | including visits to the secondary class. This |
8 | | evaluation shall be limited to the course and the |
9 | | ability of the instructor to deliver quality, rigorous |
10 | | college credit coursework. This evaluation shall not |
11 | | impact the instructor's performance evaluation. |
12 | | (C) The academic supports and, if applicable, |
13 | | guidance that will be provided to students |
14 | | participating in the program by the high school and the |
15 | | community college district. |
16 | | (8) Identify all fees and costs to be assessed by the |
17 | | community college district for dual credit courses. This |
18 | | provision shall require that any fees and costs assessed |
19 | | for dual credit courses shall be reasonable and promote |
20 | | student access to those courses, and may take into account |
21 | | regional considerations and differences. |
22 | | (9) The community college district shall establish a |
23 | | mechanism for evaluating and documenting on a regular basis |
24 | | the performance of students who complete dual credit |
25 | | courses, consistent with paragraph (9) of Section 20 and |
26 | | Section 30 of this Act, and for sharing that data in a |

1 | | meaningful and timely manner with the school district. This |
2 | | evaluation shall be limited to the course and the |
3 | | coursework. This evaluation shall not impact the |
4 | | instructor's performance evaluation. |
5 | | If, within 180 calendar days of the school district's |
6 | | initial request to enter into a partnership agreement with the |
7 | | community college district, the school district and the |
8 | | community college district do not reach agreement on the |
9 | | partnership agreement, then the school district and community |
10 | | college district shall jointly implement the provisions of the |
11 | | Model Partnership Agreement established under Section 19 of |
12 | | this Act. A community college district may combine its |
13 | | negotiations with multiple school districts to establish one |
14 | | multi-district partnership agreement or may negotiate |
15 | | individual partnership agreements at its discretion. |
16 | | (110 ILCS 27/17 new) |
17 | | Sec. 17. Out-of-State dual credit contracts. On or after |
18 | | the effective date of this amendatory Act of the 100th General |
19 | | Assembly, a school district may not enter into a new contract |
20 | | with an out-of-state institution to provide a dual credit |
21 | | course without first offering the community college district in |
22 | | the district in which the school district is located the |
23 | | opportunity to provide the course. Prior to entering into a |
24 | | contract with an out-of-state institution, the school district |
25 | | shall notify the Board of Higher Education of its intent to |

1 | | enter into an agreement with an out-of-state institution. The |
2 | | Board of Higher Education shall have 30 days to provide the |
3 | | school district with a list of in-state institutions that can |
4 | | provide the school district an equivalent dual credit |
5 | | opportunity. In deciding which dual credit courses to offer, a |
6 | | school district reserves the right to evaluate any dual credit |
7 | | course offered by any institution for quality, rigor, and |
8 | | alignment with the school district's students' needs. |
9 | | Agreements to provide dual credit courses between a school |
10 | | district and an out-of-state institution in existence on the |
11 | | effective date of this amendatory Act of the 100th General |
12 | | Assembly shall remain in effect and shall not be impacted by |
13 | | this Section. |
14 | | (110 ILCS 27/18 new) |
15 | | Sec. 18. Recognition of dual credit coursework completion. |
16 | | Any General Education Core Curriculum dual credit coursework |
17 | | completed by a high school student under this Act must be |
18 | | recognized as credit-bearing college-level coursework meeting |
19 | | General Education Core Curriculum requirements, consistent |
20 | | with the Illinois Articulation Act, if the course or courses |
21 | | have an existing Illinois Articulation Initiative code at the |
22 | | community college. Dual credit coursework completed by a high |
23 | | school student under this Act is transferrable to all public |
24 | | institutions in this State on the same basis as completed by a |
25 | | public community college student who has previously earned a |

1 | | high school diploma in the manner set forth under the Illinois |
2 | | Articulation Initiative Act. |
3 | | (110 ILCS 27/19 new) |
4 | | Sec. 19. Model Partnership Agreement and Dual Credit |
5 | | Committee. A Model Partnership Agreement shall be developed |
6 | | through a Dual Credit Committee involving collaboration |
7 | | between the Illinois Community College Board and the State |
8 | | Board of Education by June 30, 2019. The Committee shall |
9 | | consist of 5 members appointed by the State Superintendent of |
10 | | Education and 5 members appointed by the Executive Director of |
11 | | the Illinois Community College Board. The Model Partnership |
12 | | Agreement shall address all of the matters set forth in Section |
13 | | 16 of this Act. |
14 | | (110 ILCS 27/20)

15 | | Sec. 20. Standards. All institutions offering dual credit |
16 | | courses shall meet the following standards: |
17 | | (1) Instructors teaching credit-bearing college-level |
18 | | courses for dual credit must meet the following academic |
19 | | credential requirements and need not meet higher |
20 | | certification requirements or those set out in Article 21B |
21 | | of the School Code: |
22 | | (A) Approved instructors of dual credit courses |
23 | | shall meet any of the faculty credential standards |
24 | | allowed by the Higher Learning Commission to determine |

1 | | minimally qualified faculty. At the request of an |
2 | | instructor, any instructor who meets these credential |
3 | | standards shall be provided by the State Board of |
4 | | Education with a Dual Credit Endorsement to be placed |
5 | | on the professional educator license, as authorized by |
6 | | the State Board of Education under Article 21B of the |
7 | | School Code and promulgated through administrative |
8 | | rule in cooperation with the Illinois Community |
9 | | College Board and the Board of Higher Education. |
10 | | (B) An instructor that does not meet the faculty |
11 | | credential standards allowed by the Higher Learning |
12 | | Commission to determine minimally qualified faculty |
13 | | may teach dual credit courses if the instructor has a |
14 | | professional development plan, approved by the |
15 | | institution, to raise his or her credentials to be in |
16 | | line with the credentials under subparagraph (A) of |
17 | | this Section. The institution shall have 30 days to |
18 | | review the plan and shall approve instructor |
19 | | professional development plans that are in line with |
20 | | the credentials set forth in paragraph 2 of this |
21 | | Section. The institution shall not unreasonably |
22 | | withhold approval of a professional development plan. |
23 | | These approvals shall be good for as long a |
24 | | satisfactory progress toward the completion of the |
25 | | credential is demonstrated. A high school instructor |
26 | | whose professional development plan is not approved by |

1 | | the institution may appeal to the Illinois Community |
2 | | College Board or the Board of Higher Education, as |
3 | | appropriate. |
4 | | (2) A high school instructor shall qualify for a |
5 | | professional development plan if the instructor: |
6 | | (A) has a master's degree in any discipline and has |
7 | | earned 9 graduate hours in a discipline in which he or |
8 | | she is currently teaching or expects to teach; or |
9 | | (B) has a bachelor Degree with a minimum of 18 |
10 | | graduate hours in a discipline that he or she is |
11 | | currently teaching or expects to teach and is enrolled |
12 | | in a discipline-specific masters degree program; and |
13 | | (C) agrees to demonstrate his or her progress |
14 | | toward completion to the supervising institution, as |
15 | | outlined in the professional development plan. |
16 | | (3) An instructor in career and technical education |
17 | | courses must possess the credentials and demonstrated |
18 | | teaching competencies appropriate to the field of |
19 | | instruction. |
20 | | (4) Course content must be equivalent to |
21 | | credit-bearing college-level courses offered at the |
22 | | community college. |
23 | | (5) Learning outcomes must be the same as |
24 | | credit-bearing college-level courses and be appropriately |
25 | | measured. |
26 | | (6) A high school instructor is expected to participate |

1 | | in any orientation developed by the institution for dual |
2 | | credit instructors in course curriculum, assessment |
3 | | methods, and administrative requirements. |
4 | | (1) Instructors teaching credit-bearing college-level |
5 | | courses for dual credit must meet the same academic |
6 | | credential requirements as faculty teaching on campus and |
7 | | need not meet certification requirements set out in Article |
8 | | 21 of the School Code. |
9 | | (2) Instructors in career and technical education |
10 | | courses must possess the credentials and demonstrated |
11 | | teaching competencies appropriate to the field of |
12 | | instruction. |
13 | | (3) Students must meet the same academic criteria as |
14 | | those enrolled in credit-bearing college courses, |
15 | | including taking appropriate placement testing. |
16 | | (4) Course content must be the same as that required |
17 | | for credit-bearing college courses. |
18 | | (5) Learning outcomes must be the same as for |
19 | | credit-bearing college courses and be appropriately |
20 | | measured. |
21 | | (6) Institutions shall provide high school instructors |
22 | | with an orientation in course curriculum, assessment |
23 | | methods, and administrative requirements before high |
24 | | school instructors are permitted to teach dual credit |
25 | | courses. |
26 | | (7) Dual credit instructors must be given the |

1 | | opportunity to participate in all activities available to |
2 | | other adjunct faculty, including professional development, |
3 | | seminars, site visits, and internal communication, |
4 | | provided that such opportunities do not interfere with an |
5 | | instructor's regular teaching duties. |
6 | | (8) Every dual credit course must be reviewed annually |
7 | | by faculty through the appropriate department to ensure |
8 | | consistency with campus courses.

9 | | (9) Dual credit students must be assessed using methods |
10 | | consistent with students in traditional credit-bearing |
11 | | college courses.

14 | | Sec. 35. Dual Credit Grant. Subject to appropriation, the |
15 | | Illinois Community College Board shall award funds to community |
16 | | college districts to expand their service and lower costs for |
17 | | high school students desiring to take college-level classes |
18 | | prior to receiving their high school diploma to accelerate |
19 | | their college coursework. ".
