SYNOPSIS AS INTRODUCED:

10 ILCS 5/3-6

Amends the Election Code. Provides that notwithstanding any other provision of law, a person who is age 16 or over, does not meet the voting age requirements under specified provisions of the Code, and is otherwise qualified to vote shall be preregistered to vote when the person applies for a driver's license at a Secretary of State Driver Services facility, unless the person opts out of the preregistration. Provides that the Secretary of State shall transmit to the State Board of Elections the information necessary for the State Board of Elections to register the person to vote once the person meets the voting age requirements specified in the Code. Provides that the person must be given the option to opt out of the preregistration. Provides that notwithstanding any other provision of law, a person who is otherwise qualified to vote may preregister to vote on or after that person's 16th birthday. Provides that for the purposes of the Code, an individual who is 16 years of age or older (rather than who is 17 years of age and who will be 18 years of age on the date of the general or consolidated election) shall be deemed competent to execute and attest to any voter registration forms.

A BILL FOR

AN ACT concerning elections.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Election Code is amended by changing Section 3-6 and by adding Section 1A-16.10 as follows:

Sec. 1A-16.10. Automatic voter preregistration. Notwithstanding any other provision of law, a person who is age 16 or over, does not meet the voting age requirements of Section 3-6, and is otherwise qualified to vote shall be preregistered to vote when the person applies for a driver's license at a Secretary of State Driver Services facility, unless the person opts out of the preregistration. The Secretary of State shall transmit to the State Board of Elections the information necessary for the State Board of Elections to register the person to vote once the person meets the voting age requirements under Section 3-6. The person must be given the option to opt out of preregistration under this Section.

Sec. 3-6. Voting and registration age.

Notwithstanding any other provision of law, a person who is otherwise qualified to vote may preregister to vote on or after that person's 16th birthday in accordance with Section 1A-16.10.

Notwithstanding any other provision of law, a person who is 17 years old on the date of a caucus, general primary election, or consolidated primary election and who is otherwise qualified to vote is qualified to vote at that caucus, general primary, or consolidated primary, including voting a vote by mail, grace period, or early voting ballot with respect to that general primary or consolidated primary, if that person will be 18 years old on the date of the immediately following general election or consolidated election for which candidates are nominated at that primary.

For the purposes of this Code, a person who is 16 years of age or older shall be deemed competent to execute and attest to any voter registration forms.

References in this Code and elsewhere to the requirement that a person must be 18 years old to vote shall be interpreted in accordance with this Section.

For the purposes of this Code, an individual who is 17 years of age and who will be 18 years of age on the date of the general or consolidated election shall be deemed competent to execute and attest to any voter registration forms. An individual who is 17 years of age, will be 18 years of age on the date of the immediately following general or consolidated election, and is otherwise qualified to vote shall be deemed eligible to circulate a nominating petition or a petition proposing a public question.
