SYNOPSIS AS INTRODUCED:
 

 
  
40 ILCS 5/7-175.1  from Ch. 108 1/2, par. 7-175.1

     Amends the Illinois Municipal Retirement Fund (IMRF) Article of the Illinois Pension Code. Provides that nothing in provisions concerning the election of employee and annuitant trustees shall preclude the Board of Trustees of the Illinois Municipal Retirement Fund from adopting rules that provide for Internet balloting or phone balloting in addition to election by mail. Provides that an Internet or phone ballot cast in accordance with these rules shall be a valid ballot. Effective January 1, 2019.

1    AN ACT concerning public employee benefits.
  
 
2    Be it enacted by the People of the State of Illinois,
 
3represented in the General Assembly:
  
 
 
4    Section 5. The Illinois Pension Code is amended  by changing 
5Section 7-175.1 as follows:
 



6    (40 ILCS 5/7-175.1)  (from Ch. 108 1/2, par. 7-175.1)



7    Sec. 7-175.1. Election of employee and annuitant trustees. 

8    (a) The board shall prepare and send ballots and ballot 
9envelopes to the
employees and annuitants eligible to vote as 
10of September of that
year.  The ballots shall contain the names 
11of all candidates in alphabetical
order and an appropriate 
12place where a name may be written in on
the ballot.
The ballot 
13envelope shall have on the outside a form of certificate 
14stating
that the person voting the ballot is a participating 
15employee or annuitant
entitled to vote.

16    (b) Employees and annuitants, upon receipt of the ballot, 
17shall vote the
ballot and place it in the ballot envelope, seal 
18the envelope, execute the
certificate thereon and return the 
19ballot to the Fund.

20    (c) The board shall set a final date for ballot return, and 
21ballots
received prior to that date in a ballot envelope with a

22properly executed certificate and properly voted, shall be 
23valid ballots.

1    (d) The board shall set a day for counting the ballots and

2name judges and clerks of election to conduct the count of 
3ballots, and shall
make any rules and regulations necessary for 
4the conduct of the
count.

5    (e) No election under this Section shall be required if a 
6candidate is deemed the winner under subsection (g) of Section 
77-175. 
8    (f) Nothing in this Section shall preclude the Board from 
9adopting rules that provide for Internet balloting or phone 
10balloting in addition to election by mail under this Section. 
11An Internet or phone ballot cast in accordance with rules 
12adopted under this subsection shall be a valid ballot.

14    Section 99. Effective date. This Act takes effect January 
151, 2019.
