2 | | AMENDMENT NO. ______. Amend Senate Bill 2808 by replacing |
3 | | everything after the enacting clause with the following:

4 | | "Section 5. The Alzheimer's Disease and Related Dementias |
5 | | Services Act is amended by changing Sections 15, 30, and 35 as |
6 | | follows: |

9 | | Sec. 15. Applicability. Programs covered by this Act |
10 | | include, but are not limited to, health care facilities |
11 | | licensed or certified by the Assisted Living and Shared Housing |
12 | | Act; Life Care Facilities Act; Nursing Home Care Act; |
13 | | Specialized Mental Health Rehabilitation Act of 2013; Home |
14 | | Health, Home Services, and Home Nursing Agency Licensing Act; |
15 | | and Hospice Program Licensing Act ; and End Stage Renal Disease |
16 | | Facility Act . This Act does not apply to physicians licensed to |

1 | | practice medicine in all its branches.

5 | | Sec. 30. Staff training. |
6 | | (a) Staff with direct access to clients with Alzheimer's |
7 | | disease or a related dementia hired prior to the adoption of |
8 | | rules implementing this Act shall receive a minimum of 6 hours |
9 | | of initial training within 90 days after the effective date of |
10 | | this Act using an Alzheimer's disease and related dementias |
11 | | services curriculum compiled certified by the Department, |
12 | | except as provided in subsection (c). |
13 | | (b) Staff with direct access to clients with Alzheimer's |
14 | | disease or a related dementia hired after the adoption of rules |
15 | | implementing this Act shall complete a minimum of 6 hours of |
16 | | initial training in the first 60 days of employment using an |
17 | | Alzheimer's disease and related dementias services curriculum |
18 | | compiled certified by the Department, except as provided in |
19 | | subsection (c). |
20 | | (c) Subsections (a) and (b) shall not apply to the |
21 | | following: |
22 | | (1) staff who received at least 6 hours of comparable |
23 | | training in compliance with licensure or certified |
24 | | training requirements; and |
25 | | (2) staff temporarily hired or temporarily detailed by |

1 | | a facility licensed under the Nursing Home Care Act to |
2 | | permit the facility to meet statutory staffing |
3 | | requirements. |
4 | | (d) An Alzheimer's disease and related dementias services |
5 | | curriculum compiled certified by the Department and published |
6 | | on the Department's website must include at a minimum the |
7 | | following topics: understanding dementia, effectively |
8 | | communicating with individuals with dementia, assisting |
9 | | individuals with dementia in performing activities of daily |
10 | | living, problem solving with individuals with dementia who |
11 | | exhibit challenging behavior, fundamentals of dementia care, |
12 | | safe environments, and managing the activities of individuals |
13 | | with dementia. |
14 | | (e) An individual who received training consistent with the |
15 | | requirements of this Section while employed by another program |
16 | | or through an educational institution or an individual with 3 |
17 | | or more years of experience working with Alzheimer's disease |
18 | | and related dementias services may petition the Department for |
19 | | a waiver of the initial training requirements set forth in this |
20 | | Section. The Department shall evaluate each request on a case |
21 | | by case basis. |
22 | | (f) Upon the adoption of rules implementing this Act, staff |
23 | | with direct access to clients with dementia shall receive 3 |
24 | | hours of advanced training on caring for individuals with |
25 | | Alzheimer's disease and related dementias each year. |
26 | | (g) Upon the adoption of rules implementing this Act, |

2 | | employers shall maintain training records and make them |
3 | | available to the Department on request.

7 | | Sec. 35. Supervisor of services Program director . Upon the |
8 | | adoption of rules implementing this Act, in addition to the |
9 | | training required under Section 30 of this Act, a manager, |
10 | | supervisor, or person with the chief responsibility of |
11 | | oversight of the director of an Alzheimer's disease and related |
12 | | dementias services within an entity program shall complete an |
13 | | Alzheimer's disease and related dementias services curriculum |
14 | | from a list compiled by the Department or have 5 years of |
15 | | experience as a director of an Alzheimer's disease and related |
16 | | dementias services program.
