1 | AN ACT concerning regulation.

2 | Be it enacted by the People of the State of Illinois, | ||||||
3 | represented in the General Assembly:

4 | Section 5. The Alzheimer's Disease and Related Dementias | ||||||
5 | Services Act is amended by changing Sections 15, 30, and 35 as | ||||||
6 | follows: | ||||||

9 | Sec. 15. Applicability. Programs covered by this Act | ||||||
10 | include, but are not limited to, health care facilities | ||||||
11 | licensed or certified by the Assisted Living and Shared Housing | ||||||
12 | Act; Life Care Facilities Act; Nursing Home Care Act; | ||||||
13 | Specialized Mental Health Rehabilitation Act of 2013; Home | ||||||
14 | Health, Home Services, and Home Nursing Agency Licensing Act; | ||||||
15 | and Hospice Program Licensing Act ; and End Stage Renal Disease | ||||||
16 | Facility Act . This Act does not apply to physicians licensed to | ||||||
17 | practice medicine in all its branches.

21 | Sec. 30. Staff training. | ||||||
22 | (a) (Blank). Staff with direct access to clients with |

1 | Alzheimer's disease or a related dementia hired prior to the | ||||||
2 | adoption of rules implementing this Act shall receive a minimum | ||||||
3 | of 6 hours of initial training within 90 days after the | ||||||
4 | effective date of this Act using Alzheimer's disease and | ||||||
5 | related dementias services certified by the Department, except | ||||||
6 | as provided in subsection (c). | ||||||
7 | (b) Staff with direct access to clients with Alzheimer's | ||||||
8 | disease or a related dementia hired after the adoption of rules | ||||||
9 | implementing this Act shall complete a minimum of 6 hours of | ||||||
10 | initial training in the first 60 days of employment using an | ||||||
11 | Alzheimer's disease and related dementias services curriculum | ||||||
12 | compiled certified by the Department, except as provided in | ||||||
13 | subsection (c). | ||||||
14 | (c) Subsection Subsections (a) and (b) shall not apply to | ||||||
15 | the following: | ||||||
16 | (1) staff who received at least 6 hours of comparable | ||||||
17 | training in compliance with licensure or certified | ||||||
18 | training requirements; and | ||||||
19 | (2) staff temporarily hired or temporarily detailed by | ||||||
20 | a facility licensed under the Nursing Home Care Act to | ||||||
21 | permit the facility to meet statutory staffing | ||||||
22 | requirements. | ||||||
23 | (d) An Alzheimer's disease and related dementias services | ||||||
24 | curriculum compiled certified by the Department and published | ||||||
25 | on the Department's website must include at a minimum the | ||||||
26 | following topics: understanding dementia, effectively |

1 | communicating with individuals with dementia, assisting | ||||||
2 | individuals with dementia in performing activities of daily | ||||||
3 | living, problem solving with individuals with dementia who | ||||||
4 | exhibit challenging behavior, fundamentals of dementia care, | ||||||
5 | safe environments, and managing the activities of individuals | ||||||
6 | with dementia. | ||||||
7 | (e) (Blank). An individual who received training | ||||||
8 | consistent with the requirements of this Section while employed | ||||||
9 | by another program or through an educational institution or an | ||||||
10 | individual with 3 or more years of experience working with | ||||||
11 | Alzheimer's disease and related dementias services may | ||||||
12 | petition the Department for a waiver of the initial training | ||||||
13 | requirements set forth in this Section. The Department shall | ||||||
14 | evaluate each request on a case by case basis. | ||||||
15 | (f) Upon the adoption of rules implementing this Act, staff | ||||||
16 | with direct access to clients with dementia shall receive 3 | ||||||
17 | hours of advanced training on caring for individuals with | ||||||
18 | Alzheimer's disease and related dementias each year. | ||||||
19 | (g) Upon the adoption of rules implementing this Act, | ||||||
20 | Alzheimer's disease and related dementias services program | ||||||
21 | employers shall maintain training records and make them | ||||||
22 | available to the Department on request.

1 | Sec. 35. Supervisor of services Program director . Upon the | ||||||
2 | adoption of rules implementing this Act, in addition to the | ||||||
3 | training required under Section 30 of this Act, a manager, | ||||||
4 | supervisor, or person with the chief responsibility of | ||||||
5 | oversight of the director of an Alzheimer's disease and related | ||||||
6 | dementias services within an entity program shall complete an | ||||||
7 | Alzheimer's disease and related dementias services curriculum | ||||||
8 | from a list compiled by the Department or have 5 years of | ||||||
9 | experience as a director of an Alzheimer's disease and related | ||||||
10 | dementias services program.
