the Illinois Community College Board and |
2 | | the campuses under their governance
or supervision shall not |
3 | | hereafter undertake the establishment of any new
unit of |
4 | | instruction, research or public service without the approval of |
5 | | the
Board. The term "new unit of instruction, research or |
6 | | public service"
includes the establishment of a college, |
7 | | school, division, institute,
department or other unit in any |
8 | | field of instruction, research or public
service not |
9 | | theretofore included in the program of the institution, and
|
10 | | includes the establishment of any new branch or campus. The |
11 | | term does not
include reasonable and moderate extensions of |
12 | | existing curricula, research,
or public service programs which |
13 | | have a direct relationship to existing
programs; and the Board |
14 | | may, under its rule making power, define the
character of such |
15 | | reasonable and moderate extensions.

16 | | Such governing boards shall submit to the Board all |
17 | | proposals for a new
unit of instruction, research, or public |
18 | | service. The Board may approve or
disapprove the proposal in |
19 | | whole or in part or approve modifications
thereof whenever in |
20 | | its judgment such action is consistent with the
objectives of |
21 | | an existing or proposed master plan of higher education.

22 | | The Board of Higher Education is authorized to review |
23 | | periodically all
existing programs of instruction, research |
24 | | and public service at the State
universities and colleges and |
25 | | to advise the appropriate board of control if
the contribution |
26 | | of each program is not educationally and economically

1 | | justified. Each State university shall report annually to the |
2 | | Board on programs of instruction, research, or public service |
3 | | that have been terminated, dissolved, reduced, or consolidated |
4 | | by the university. Each State university shall also report to |
5 | | the Board all programs of instruction, research, and public |
6 | | service that exhibit a trend of low performance in enrollments, |
7 | | degree completions, and high expense per degree. The Board may |
8 | | require the elimination of any program of instruction, |
9 | | research, or public service at a State university that exhibits |
10 | | a trend of low performance. The Board shall compile an annual |
11 | | report that shall contain information on new programs created, |
12 | | existing programs that have been closed , eliminated, or |
13 | | consolidated, and programs that exhibit low performance or |
14 | | productivity. The report must be submitted to the General |
15 | | Assembly. The Board shall have the authority to define relevant |
16 | | terms and timelines by rule with respect to this reporting.

19 | | Sec. 9.38. Evaluation of programmatic expansions and new |
20 | | programs. In evaluating programmatic expansions and new |
21 | | programs at public institutions of higher education, the Board, |
22 | | prior to approving such expansions or new programs, shall make |
23 | | the following findings: |
24 | | (1) that such an expansion or new program is meeting an |
25 | | unmet need in that region of the State or serving an |

|
1 | | unserved or underserved population; |
2 | | (2) in cases in which subdivision (1) of this Section |
3 | | cannot be satisfied, that a market-demand analysis has been |
4 | | performed to rationally justify that growth opportunity in |
5 | | the area will be forthcoming in the immediate future; |
6 | | (3) that the institution has the ability, if so |
7 | | approved, to offer a quality program at a price point that |
8 | | is cheaper for students than existing options elsewhere in |
9 | | the area; and |
10 | | (4) that the opening of such a program does not |
11 | | negatively impact the optimal efficiency of the existing |
12 | | higher education infrastructure in this State. ".
