1 | AN ACT concerning State government.

2 | Be it enacted by the People of the State of Illinois, | ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Children and Family Services Act is amended | ||||||
5 | by adding Section 5f as follows: | ||||||
6 | (20 ILCS 505/5f new) | ||||||
7 | Sec. 5f. Payment rate increases for reimbursable services. | ||||||
8 | (a) For State Fiscal Year 2019, the Department shall | ||||||
9 | increase reimbursement rates payable to each foster parent and | ||||||
10 | to each private agency with a purchase of service contract or | ||||||
11 | grant from the Department to an amount that equals the sum of | ||||||
12 | all increases in general inflation during State Fiscal Years | ||||||
13 | 2009 through 2018 as determined by the Consumer Price Index as | ||||||
14 | published by the Bureau of Labor Statistics of the U.S. | ||||||
15 | Department of Labor, less any rate increases previously | ||||||
16 | provided by the Department. The contractual and grant services | ||||||
17 | eligible for increased reimbursement rates under this Section | ||||||
18 | include the following: | ||||||
19 | (1) Residential services, including child care | ||||||
20 | institution, group home care, independent living services, | ||||||
21 | or transitional living services. | ||||||
22 | (2)
Specialized, adolescent, treatment, or other | ||||||
23 | non-traditional or Home-of-Relative foster care. |

Traditional or Home-of-Relative foster care. | ||||||

Intact family services. | ||||||
3 | (5)
Teen parenting services. | ||||||
4 | (6)
Other supportive service grants or contracts. | ||||||
5 | (b) Beginning in State Fiscal Year 2020, and for every | ||||||
6 | State Fiscal Year thereafter, the Department shall implement | ||||||
7 | the rate reimbursement methodology outlined in 89 Ill. Adm. | ||||||
8 | Code 356.5(f) when calculating and determining the payment | ||||||
9 | rates for private agencies that contract with the Department to | ||||||
10 | provide any of the services enumerated in 89 Ill. Adm. Code | ||||||
11 | 356.5(f) and in paragraph (1) of subsection (a) of this | ||||||
12 | Section. Payment rates calculated and determined as provided in | ||||||
13 | this Section shall include an amount equal to any increase in | ||||||
14 | general inflation as determined by the Consumer Price Index. | ||||||
15 | For services listed under paragraphs (2) through (6) of | ||||||
16 | subsection (a), the Department shall establish a rate model | ||||||
17 | based upon staffing and service expectations for each type of | ||||||
18 | care within 9 months of the start of State Fiscal Year 2019. | ||||||
19 | For State Fiscal Year 2020 and for every State Fiscal Year | ||||||
20 | thereafter, the rate shall be adjusted to an amount equal to | ||||||
21 | any increase in general inflation as determined by the Consumer | ||||||
22 | Price Index. | ||||||
23 | The Department shall increase each foster parent rate each | ||||||
24 | year by an amount equal to any increase in general inflation as | ||||||
25 | determined by the Consumer Price Index.

26 | Section 99. Effective date. This Act takes effect upon |
