Amends the Election Code. Provides that the disclosure requirements for political communications shall also apply to any political committee, organized under the Code, making a political communication utilizing any social media platform.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Election Code is amended by changing Section |
5 | | 9-9.5 as follows: |
6 | | (10 ILCS 5/9-9.5)
|
7 | | Sec. 9-9.5. Disclosures in political communications. |
8 | | (a)
Any political committee, organized under the Election |
9 | | Code, that
makes an expenditure for a pamphlet, circular, |
10 | | handbill, Internet or telephone communication, radio, |
11 | | television,
or print advertisement,
or other communication , |
12 | | including, but not limited to, utilizing any social media |
13 | | platform, directed at voters and
mentioning the name of a |
14 | | candidate in the next upcoming election shall ensure
that the |
15 | | name of the political committee paying for any part of the
|
16 | | communication, including, but not limited to, its preparation |
17 | | and distribution,
is
identified clearly within the |
18 | | communication as the payor. This subsection does
not apply to |
19 | | items that are too small to contain the required disclosure.

20 | | This subsection does not apply to an expenditure for the |
21 | | preparation, distribution, or publication of any communication |
22 | | directed at constituents of a member of the General Assembly if |
23 | | the expenditure is made by a political committee in accordance |

1 | | with subsection (c) of Section 9-8.10. Nothing in this |
2 | | subsection shall require disclosure on any telephone |
3 | | communication using random sampling or other scientific survey |
4 | | methods to gauge public opinion for or against any candidate or |
5 | | question of public policy.

6 | | Whenever any vendor or other person provides any of the |
7 | | services listed in this subsection, other than any telephone |
8 | | communication using random sampling or other scientific survey |
9 | | methods to gauge public opinion for or against any candidate or |
10 | | question of public policy, the vendor or person shall keep and |
11 | | maintain records showing the name and address of the person who |
12 | | purchased or requested the services and the amount paid for the |
13 | | services. The records required by this subsection shall be kept |
14 | | for a period of one year after the date upon which payment was |
15 | | received for the services.

16 | | (b) Any political committee, organized under this Code,
|
17 | | that makes an expenditure for a pamphlet, circular, handbill,
|
18 | | Internet or telephone communication, radio, television, or
|
19 | | print advertisement, or other communication , including, but |
20 | | not limited to, utilizing any social media platform, directed |
21 | | at voters
and (i) mentioning the name of a candidate in the |
22 | | next upcoming
election, without that candidate's permission, |
23 | | or
(ii)
advocating for or against a public policy position |
24 | | shall ensure
that the name of the political committee paying |
25 | | for any part of
the communication, including, but not limited |
26 | | to, its
preparation and distribution, is identified clearly |

communication. Nothing in this subsection shall |
2 | | require disclosure on
any telephone communication using random |
3 | | sampling or other

6 | | (c) A political committee organized under this Code shall
|
7 | | not make an expenditure for any unsolicited telephone call to
|
8 | | the line of a residential telephone customer in this State
|
9 | | using any method to block or otherwise circumvent that
|
10 | | customer's use of a caller identification service.
