Creates the Mass Transportation Safety Act. Provides that a mass transportation carrier shall provide to a person operating a commercial motor vehicle for the purpose of providing mass transportation a rest period of not less than 10 minutes for every segment of 4 hours, or major part thereof, to use the nearest convenient restroom without deduction from the employee's pay. Provides that the Act does not prohibit employers and employees from establishing, under a collective bargaining agreement, appropriate rest periods different from those provided in the Act. Defines terms.

1 | | AN ACT concerning safety.

2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:

4 | | Section 1. Short title. This Act may be cited as the Mass |
5 | | Transportation Safety Act. |
6 | | Section 5. Purpose. The purpose of this Act is to provide |
7 | | for the health of mass transportation employees and the safety |
8 | | of transit passengers, other commercial and non-commercial |
9 | | motor vehicle operators, and pedestrians. |
10 | | Section 10. Definitions. In this Act: |
11 | | "Appropriate rest period" means a period of rest of not |
12 | | less than 10 minutes for every segment of 4 hours, or major |
13 | | part thereof, worked in one work period. |
14 | | "Carrier" means any corporation, authority, partnership, |
15 | | association, person, or district authorized to provide mass |
16 | | transportation within this State. |
17 | | "Mass transportation" means transportation provided within |
18 | | this State by rail, bus, or other conveyance and available to |
19 | | the general public on a regular and continuing, basis, |
20 | | including the transportation of elderly persons or persons with |
21 | | a disability, as defined in Section 2705-310 of the Department |
22 | | of Transportation Law. |
