Amends the Medical Assistance Article of the Illinois Public Aid Code. Requires the Department of Healthcare and Family Services to disregard life insurance assets up to a total of $200,000 when determining whether a person 60 years of age or older meets the income and asset eligibility requirements for home and community based services authorized under the Social Security Act. Provides that if the asset disregard requires federal approval, the Department shall submit the necessary application to the Centers for Medicare and Medicaid Services for a waiver or State Plan amendment to implement the asset disregard. Provides that implementation of the asset disregard shall be contingent on federal approval of the waiver or State Plan amendment.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The Illinois Public Aid Code is amended by |
5 | | adding Section 5-5.27 as follows: |
6 | | (305 ILCS 5/5-5.27 new) |
7 | | Sec. 5-5.27. Home and community based services; life |
8 | | insurance asset disregard. The Department shall disregard life |
9 | | insurance assets up to a total of $200,000 when determining |
10 | | whether a person 60 years of age or older meets the income and |
11 | | asset eligibility requirements for home and community based |
12 | | services authorized under Section 1915(c) of the Social |
13 | | Security Act. If the asset disregard described in this Section |
14 | | requires federal approval, the Department shall submit the |
15 | | necessary application to the Centers for Medicare and Medicaid |
16 | | Services for a waiver or State Plan amendment to implement the |
17 | | asset disregard. Implementation of the asset disregard shall be |
18 | | contingent on federal approval of the waiver or State Plan |
19 | | amendment.
