AMENDMENT TO SENATE BILL 887




2    AMENDMENT NO. ______. Amend Senate Bill 887 by replacing 
3everything after the enacting clause with the following:


 
 
4    "Section 5. The State Finance Act is amended  by changing 
5Section 5.652 and by adding Section 5.878 as follows:

7    Sec. 5.652. The ICCB Research and Technology Instructional 
8Development and Enhancement Applications Revolving  Fund.

11    Sec. 5.878. The BHE Data and Research Cost Recovery Fund.
 
12    Section 7. The Board of Higher Education Act is amended by 
13adding Section 9.36 as follows:

1    (110 ILCS 205/9.36 new)
2    Sec. 9.36. Processing fee.
3    (a)   The Board may collect a fee to cover the cost of 
4processing and handling individual student-level data requests 
5pursuant to an approved data sharing agreement. The fee shall 
6not be assessed on any entities that are complying with State 
7or federal-mandated reporting. The fee shall be set by the 
8Board by rule. Money from the fee shall be deposited into the 
9BHE Data and Research Cost Recovery Fund.
10    (b)   The BHE Data and Research Cost Recovery Fund is created 
11as a special fund in the State treasury. The Board shall 
12deposit into the Fund moneys received from processing requests 
13for individual student-level data.  All moneys in the Fund shall 
14be used by the Board, subject to appropriation, for costs 
15associated with maintaining and updating the individual 
16student-level data systems.
 
17    Section 10. The Public Community College Act is amended  by 
18changing Section 2-16.09 and  by adding Section 2-11.2 as 
19follows:
 
20    (110 ILCS 805/2-11.2 new)
21    Sec. 2-11.2. Processing fee. The State Board may collect a

6    Sec. 2-16.09. ICCB Research and Technology Instructional 
7Development and Enhancement Applications Revolving Fund. The 
8ICCB Research and Technology Instructional Development and 
9Enhancement Applications Revolving Fund is created as a special 
10fund in the State treasury. The State Board shall deposit  into 
11the Fund moneys received by the State Board from the sale of 
12instructional technology developed by the State Board and all 
13moneys received from processing requests for individual 
14student-level data. All moneys in the Fund shall be used by the 
15State Board, subject to appropriation by the General Assembly, 
16for costs associated with maintaining and updating that 
17instructional technology and individual student-level data 
18systems.

20    Section 99. Effective date. This Act takes effect July 1,
