    AN ACT concerning insurance.
  
 
    Be it enacted by the People of the State of Illinois,
 
represented in the General Assembly:
  
 
 
    Section 5. The Illinois Insurance Code is amended  by adding 
Section 370b.1 as follows:
 
    (215 ILCS 5/370b.1 new)
    Sec. 370b.1. Surgical assistant payments. Payment for 
services rendered by a registered surgical assistant, as 
defined in the Registered Surgical Assistant and Registered 
Surgical Technologist Title Protection Act, who is neither an 
employee of an ambulatory surgical treatment center, as defined 
in the Ambulatory Surgical Treatment Center Act, nor an 
employee of a hospital shall be paid at the appropriate 
non-physician modifier rate if the payor would have made 
payment had the same services been provided by a physician.
 
    Section 10. The Registered Surgical Assistant and 
Registered Surgical
Technologist Title Protection Act is 
amended  by adding Section 47 as follows:
 
    (225 ILCS 130/47 new)
    Sec. 47. Payment; surgical assistant. Payment for services 
rendered by a registered surgical assistant who is neither an 
employee of an ambulatory surgical treatment center, as defined 
in the Ambulatory Surgical Treatment Center Act, nor an 
employee of a hospital shall be paid at the appropriate 
non-physician modifier rate if the payor would have made 
payment had the same services been provided by a physician.
