AN ACT concerning gaming.
| ||||
Be it enacted by the People of the State of Illinois,
| ||||
represented in the General Assembly:
| ||||
Section 5. The Illinois Lottery Law is amended by changing | ||||
Sections 9.3, 20, 21.5, 21.6, 21.7, 21.8, 21.9, 21.10, 21.11, | ||||
and 21.13 and by adding Sections 21.4, 21.15, 21.16, and 21.17 | ||||
as follows: | ||||
(20 ILCS 1605/9.3) | ||||
Sec. 9.3. Expenditure and distribution of lottery | ||||
proceeds. | ||||
(a) Beginning July 1, 2022, except as provided in Sections | ||||
21.4, 21.5, 21.6, 21.7, 21.8, 21.9, 21.10, 21.11, 21.12, and | ||||
21.13 , 21.15, and 21.16 of this Law Act and Section 25-70 of | ||||
the Sports Wagering Act, the Department shall distribute all | ||||
proceeds of lottery tickets and shares sold in the following | ||||
priority and manner: | ||||
(1) The payment of prizes and retailer bonuses. | ||||
(2) The payment of costs incurred in the operation and | ||||
administration of the Lottery, including the payment of | ||||
sums due to the private manager under the management | ||||
agreement with the Department and including costs of | ||||
administering the Lottery sports wagering program pursuant | ||||
to Section 25-70 of the Sports Wagering Act. |
(3) On the last day of each month or as soon thereafter | ||
as possible, the State Comptroller shall direct and the | ||
State Treasurer shall transfer from the State Lottery Fund | ||
to the Common School Fund the Department's estimate of net | ||
lottery proceeds. | ||
(4) If an amount in excess of the annual net lottery | ||
proceeds is transferred for a fiscal year, then the | ||
Department shall offset the monthly transfers of estimated | ||
net lottery proceeds during the following fiscal year by | ||
that excess amount. If an amount less than the annual net | ||
lottery proceeds is transferred for a fiscal year, then | ||
after the related annual fiscal year audit is completed | ||
following such fiscal year, the Department shall direct | ||
the deposit of any remaining annual net lottery proceeds | ||
from such fiscal year, subject to payments under | ||
paragraphs (1) and (2), into the Common School Fund as | ||
soon thereafter as possible. | ||
(b) The net lottery proceeds shall be determined by | ||
deducting from total annual lottery proceeds the expenditures | ||
required by paragraphs (1) and (2) of subsection (a). The | ||
total annual lottery proceeds and annual net lottery proceeds | ||
shall be determined according to generally accepted accounting | ||
principles for governmental entities and verified by an annual | ||
fiscal year audit.

Sec. 20. State Lottery Fund.
| ||
(a) There is created in the State Treasury a special fund | ||
to be
known as the State Lottery Fund. Such fund shall consist | ||
of all revenues
received from (1) the sale of lottery tickets | ||
or shares, (net of
commissions, fees
representing those | ||
expenses that are directly proportionate to the
sale of | ||
tickets or shares at the agent location, and prizes of less
| ||
than
$600 which
have been validly paid at the agent
level), (2) | ||
application fees,
and (3) all other sources including moneys | ||
credited or transferred thereto
from
any other fund
or source | ||
pursuant to law. Interest earnings of the State Lottery Fund
| ||
shall be credited to the Common School Fund. | ||
(a-5) The receipt and distribution of moneys under Section | ||
21.4 of this Act shall be in accordance with Section 21.4.
| ||
(b) The receipt and distribution of moneys under Section | ||
21.5 of this Law Act shall be in accordance with Section 21.5.
| ||
(c) The receipt and distribution of moneys under Section | ||
21.6 of this Law Act shall be in accordance with Section 21.6. | ||
(d) The receipt and distribution of moneys under Section | ||
21.7 of this Law Act shall be in accordance with Section 21.7.

The receipt and distribution of moneys under Section | ||
21.8
of this Law Act shall be in accordance with Section 21.8.

(f) The receipt and distribution of moneys under Section | ||
21.9 of this Law Act shall be in accordance with Section 21.9. | ||
(g) The receipt and distribution of moneys under Section |
21.10 of this Law Act shall be in accordance with Section | ||
21.10. | ||
(h) The receipt and distribution of moneys under Section | ||
21.11 of this Law Act shall be in accordance with Section | ||
21.11. | ||
(i) (Blank). The receipt and distribution of moneys under | ||
Section 21.12 of this Act shall be in accordance with Section | ||
21.12. | ||
(j) The receipt and distribution of moneys under Section | ||
21.13 of this Law Act shall be in accordance with Section | ||
21.13. | ||
(k) The receipt and distribution of moneys under Section | ||
25-70 of the Sports Wagering Act shall be in accordance with | ||
Section 25-70 of the Sports Wagering Act. | ||
(l) The receipt and distribution of moneys under Section | ||
21.15 of this Law shall be in accordance with Section 21.15. | ||
(m) The receipt and distribution of moneys under Section | ||
21.16 of this Law shall be in accordance with Section 21.16. | ||

(20 ILCS 1605/21.4 new) | ||
Sec. 21.4. Joint Special Instant Scratch-off game. | ||
(a) The Department shall offer a joint special instant | ||
scratch-off game for the benefit of the
special causes | ||
identified in Sections 21.5, 21.6, 21.7, 21.8, 21.9, 21.10, |
21.11, 21.13, 21.15, and 21.16. The operation of the game | ||
shall be governed by this Section and any rules adopted by the | ||
Department. The game shall commence on January 1, 2024 or as | ||
soon thereafter, at the
discretion of the Director, as is | ||
reasonably practical and shall be discontinued on January 1, | ||
2027. If any provision of this Section is
inconsistent with | ||
any other provision in the Act, then this Section governs. | ||
(b) Once the joint special instant scratch-off game is | ||
used to fund a special cause, the game
will be used to fund the | ||
special cause for the remainder of the special causes' | ||
existence per
the causes' respective Section of this Act. | ||
(c) New specialty tickets and causes authorized by this | ||
Act shall be funded by the joint special instant scratch-off | ||
game. New specialty tickets and causes after February 1, 2024 | ||
must have a sunset date. The Department shall be limited to | ||
supporting no more than 10 causes in total at any given time. | ||
(d) Net revenue received from the sale of the joint | ||
special instant scratch-off game for the
purposes of this | ||
Section shall be divided equally among the special causes the | ||
game benefits.
The Department shall transfer the net revenue | ||
into the special fund identified for each
special cause in | ||
accordance with the special cause's respective Section of this | ||
Act. As used in this Section, "net revenue" means
the total | ||
amount for which tickets have been sold less the sum of the | ||
amount paid out in
prizes and to retailers, and direct and | ||
estimated administrative expenses incurred in
operation of the |
ticket. | ||

Sec. 21.5. Carolyn Adams Ticket For The Cure. | ||
(a) The Department shall offer a special instant | ||
scratch-off game with the title of "Carolyn Adams Ticket For | ||
The Cure". The game shall commence on January 1, 2006 or as | ||
soon thereafter, in the discretion of the Director, as is | ||
reasonably practical, and shall be discontinued on December | ||
31, 2026. The operation of the game shall be governed by this | ||
Act and any rules adopted by the Department. The Department | ||
must consult with the Carolyn Adams Ticket For The Cure Board, | ||
which is established under Section 2310-347 of the Department | ||
of Public Health Powers and Duties Law of the
Civil | ||
Administrative Code of Illinois, regarding the design and | ||
promotion of the game. If any provision of this Section is | ||
inconsistent with any other provision of this Act, then this | ||
Section governs. | ||
(b) The Carolyn Adams Ticket For The Cure Grant Fund is | ||
created as a special fund in the State treasury. The net | ||
revenue from the Carolyn Adams Ticket For The Cure special | ||
instant scratch-off game shall be deposited into the Fund for | ||
appropriation by the General Assembly solely to the Department | ||
of Public Health for the purpose of making grants to public or | ||
private entities in Illinois for the purpose of funding breast | ||
cancer research, and supportive services for breast cancer |
survivors and those impacted by breast cancer and breast | ||
cancer education. In awarding grants, the Department of Public | ||
Health shall consider criteria that includes, but is not | ||
limited to, projects and initiatives that address disparities | ||
in incidence and mortality rates of breast cancer, based on | ||
data from the Illinois Cancer Registry, and populations facing | ||
barriers to care. The Department of Public Health shall, | ||
before grants are awarded, provide copies of all grant | ||
applications to the Carolyn Adams Ticket For The Cure Board, | ||
receive and review the Board's recommendations and comments, | ||
and consult with the Board regarding the grants. For purposes | ||
of this Section, the term "research" includes, without | ||
limitation, expenditures to develop and advance the | ||
understanding, techniques, and modalities effective in the | ||
detection, prevention, screening, and treatment of breast | ||
cancer and may include clinical trials. The grant funds may | ||
not be used for institutional, organizational, or | ||
community-based overhead costs, indirect costs, or levies. | ||
Moneys received for the purposes of this Section, | ||
including, without limitation, net revenue from the special | ||
instant scratch-off game and gifts, grants, and awards from | ||
any public or private entity, must be deposited into the Fund. | ||
Any interest earned on moneys in the Fund must be deposited | ||
into the Fund. | ||
As used in this subsection, For purposes of this | ||
subsection, "net revenue" means the total amount for which |
tickets have been sold less the sum of the amount paid out in | ||
prizes and to retailers, and
direct and estimated the actual | ||
administrative expenses of the Department solely related to | ||
the Ticket For The Cure game. | ||
(c) During the time that tickets are sold for the Carolyn | ||
Adams Ticket For The Cure game, the Department shall not | ||
unreasonably diminish the efforts devoted to marketing any | ||
other instant scratch-off lottery game. | ||
(d) The Department may adopt any rules necessary to | ||
implement and administer the provisions of this Section.

Sec. 21.6. Scratch-off for Illinois veterans. | ||
(a) The Department shall offer a special instant | ||
scratch-off game for the benefit of Illinois veterans. The | ||
game shall commence on January 1, 2006 or as soon thereafter, | ||
at the discretion of the Director, as is reasonably practical. | ||
The operation of the game shall be governed by this Act and any | ||
rules adopted by the Department. If any provision of this | ||
Section is inconsistent with any other provision of this Act, | ||
then this Section governs. | ||
(b) The Illinois Veterans Assistance Fund is created as a | ||
special fund in the State treasury. The net revenue from the | ||
Illinois veterans scratch-off game shall be deposited into the | ||
Fund for appropriation by the General Assembly solely to the |
Department of Veterans' Affairs for making grants, funding | ||
additional services, or conducting additional research | ||
projects relating to each of the following: | ||
(i) veterans' behavioral health services; | ||
(ii) veterans' homelessness; | ||
(iii) the health insurance costs of veterans; | ||
(iv) veterans' disability benefits, including but not | ||
limited to, disability benefits provided by veterans | ||
service organizations and veterans assistance commissions | ||
or centers; | ||
(v) the long-term care of veterans; provided that, | ||
beginning with moneys appropriated for fiscal year 2008, | ||
no more than 20% of such moneys shall be used for health | ||
insurance costs; | ||
(vi) veteran employment and employment training; and | ||
(vii) veterans' emergency financial assistance, | ||
including, but not limited to, past due utilities, | ||
housing, and transportation costs. | ||
In order to expend moneys from this special fund, | ||
beginning with moneys appropriated for fiscal year 2008, the | ||
Director of Veterans' Affairs shall appoint a 3-member funding | ||
authorization committee. The Director shall designate one of | ||
the members as chairperson. The committee shall meet on a | ||
quarterly basis, at a minimum, and shall authorize expenditure | ||
of moneys from the special fund by a two-thirds vote. | ||
Decisions of the committee shall not take effect unless and |
until approved by the Director of Veterans' Affairs. Each | ||
member of the committee shall serve until a replacement is | ||
named by the Director of Veterans' Affairs. One member of the | ||
committee shall be a member of the Veterans' Advisory Council. | ||
Moneys collected from the special instant scratch-off game | ||
shall be used only as a supplemental financial resource and | ||
shall not supplant existing moneys that the Department of | ||
Veterans' Affairs may currently expend for the purposes set | ||
forth in items (i) through (v).

instant scratch-off game and from gifts, grants, and awards | ||
from any public or private entity, must be deposited into the | ||
Fund. Any interest earned on moneys in the Fund must be | ||

related to the scratch-off game under this Section.

veterans scratch-off game, the Department shall not | ||
unreasonably diminish the efforts devoted to marketing any | ||
other instant scratch-off lottery game. | ||
(d) The Department may adopt any rules necessary to |
implement and administer the provisions of this Section.

Sec. 21.7. Scratch-out Multiple Sclerosis scratch-off | ||
game. | ||
(a) The Department shall offer a special instant | ||
scratch-off game for the benefit of research pertaining to | ||
multiple sclerosis. The game shall commence on July 1, 2008 or | ||
as soon thereafter, in the discretion of the Director, as is | ||
reasonably practical. The operation of the game shall be | ||
governed by this Act and any rules adopted by the Department. | ||
If any provision of this Section is inconsistent with any | ||
other provision of this Act, then this Section governs.

(b) The Multiple Sclerosis Research Fund is created as a | ||
special fund in the State treasury. The net revenue from the | ||
scratch-out multiple sclerosis scratch-off game created under | ||
this Section shall be deposited into the Fund for | ||
appropriation by the General Assembly to the Department of | ||
Public Health for the purpose of making grants to | ||
organizations in Illinois that conduct research pertaining to | ||
the repair and prevention of damage caused by an acquired | ||
demyelinating disease of the central nervous system. | ||
Moneys received for the purposes of this Section, | ||
including, without limitation, net revenue from the special | ||
instant scratch-off game and from gifts, grants, and awards |
from any public or private entity, must be deposited into the | ||
Fund. Any interest earned on moneys in the Fund must be | ||
deposited into the Fund. | ||
For purposes of this Section, the term "research" | ||
includes,
without limitation, expenditures to develop and | ||
advance the
understanding, techniques, and modalities | ||
effective for
maintaining function, mobility, and strength | ||
through preventive physical therapy or other treatments and to | ||
develop
and advance the repair, and also the prevention, of | ||
myelin, neuron, and axon damage
caused by an acquired | ||
demyelinating disease of the central
nervous system and the | ||
restoration of function, including but
not limited to, nervous | ||
system repair or neuroregeneration. | ||
The
grant funds may not be used for institutional, | ||
organizational,
or community-based overhead costs, indirect | ||
costs, or levies. | ||
As used in this subsection, For purposes of this | ||
subsection, "net revenue" means the total amount for which | ||
tickets have been sold less the sum of the amount paid out in | ||
the prizes and to retailers, and
direct and estimated the | ||
actual administrative expenses of the Department solely | ||
related to the scratch-off game under this Section. | ||
(c) During the time that tickets are sold for the | ||
scratch-out multiple sclerosis scratch-off game, the | ||
Department shall not unreasonably diminish the efforts devoted | ||
to marketing any other instant scratch-off lottery game. |
(d) The Department may adopt any rules necessary to | ||
implement and administer the provisions of this Section.

Sec. 21.8. Quality of Life scratch-off game. | ||
(a) The Department shall offer a special instant | ||
scratch-off game with the title of "Quality of Life". The game | ||
shall commence on July 1, 2007 or as soon thereafter, in the | ||
discretion of the Director, as is reasonably practical, and | ||
shall be discontinued on December 31, 2025. The operation of | ||
the game is governed by this Act and by any rules adopted by | ||
the Department. The Department must consult with the Quality | ||
of Life Board, which is established under Section 2310-348 of | ||
the Department of Public Health Powers and Duties Law of the
| ||
Civil Administrative Code of Illinois, regarding the design | ||
and promotion of the game. If any provision of this Section is | ||
inconsistent with any other provision of this Act, then this | ||
Section governs. | ||
(b) The Quality of Life Endowment Fund is created as a | ||
special fund in the State treasury. The net revenue from the | ||
Quality of Life special instant scratch-off game must be | ||
deposited into the Fund for appropriation by the General | ||
Assembly solely to the Department of Public Health for the | ||
purpose of HIV/AIDS-prevention education and for making grants | ||
to public or private entities in Illinois for the purpose of |
funding organizations that serve the highest at-risk | ||
categories for contracting HIV or developing AIDS. Grants | ||
shall be targeted to serve at-risk populations in proportion | ||
to the distribution of recent reported Illinois HIV/AIDS cases | ||
among risk groups as reported by the Illinois Department of | ||
Public Health. The recipient organizations must be engaged in | ||
HIV/AIDS-prevention education and HIV/AIDS healthcare | ||
treatment. The Department must, before grants are awarded, | ||
provide copies of all grant applications to the Quality of | ||
Life Board, receive and review the Board's recommendations and | ||
comments, and consult with the Board regarding the grants. | ||
Organizational size will determine an organization's | ||
competitive slot in the "Request for Proposal" process. | ||
Organizations with an annual budget of $300,000 or less will | ||
compete with like size organizations for 50% of the Quality of | ||
Life annual fund. Organizations with an annual budget of | ||
$300,001 to $700,000 will compete with like organizations for | ||
25% of the Quality of Life annual fund, and organizations with | ||
an annual budget of $700,001 and upward will compete with like | ||
organizations for 25% of the Quality of Life annual fund. The | ||
lottery may designate a percentage of proceeds for marketing | ||
purposes. The grant funds may not be used for institutional, | ||
organizational, or community-based overhead costs, indirect | ||
costs, or levies. | ||
Grants awarded from the Fund are intended to augment the | ||
current and future State funding for the prevention and |
treatment of HIV/AIDS and are not intended to replace that | ||
funding.

including, without limitation, net revenue from the special | ||
instant scratch-off game and gifts, grants, and awards from | ||
any public or private entity, must be deposited into the Fund. | ||
Any interest earned on moneys in the Fund must be deposited | ||
into the Fund. | ||
As used in this subsection, For purposes of this | ||
subsection, "net revenue" means the total amount for which | ||
tickets have been sold less the sum of the amount paid out in | ||
prizes and to retailers, and
direct and estimated the actual | ||
administrative expenses of the Department solely related to | ||
the Quality of Life game. | ||
(c) During the time that tickets are sold for the Quality | ||
of Life game, the Department shall not unreasonably diminish | ||
the efforts devoted to marketing any other instant scratch-off | ||
lottery game. | ||
(d) The Department may adopt any rules necessary to | ||
implement and administer the provisions of this Section in | ||
consultation with the Quality of Life Board.

Sec. 21.9. Go For The Gold scratch-off game. | ||
(a) The Department shall offer a special instant |
scratch-off game with the title of "Go For The Gold". The game | ||
must commence on July 1, 2014 or as soon thereafter, at the | ||
discretion of the Director, as is reasonably practical. The | ||
operation of the game is governed by this Act and by any rules | ||
adopted by the Department. If any provision of this Section is | ||
inconsistent with any other provision of this Act, then this | ||
Section governs. | ||
(b) The Special Olympics Illinois and Special Children's | ||
Charities Fund is created as a special fund in the State | ||
treasury. The net revenue from the Go For The Gold special | ||
instant scratch-off game must be deposited into the Special | ||
Olympics Illinois and Special Children's Charities Fund for | ||
appropriation by the General Assembly solely to the Department | ||
of Human Services, which must distribute the moneys as | ||
follows: (i) 75% of the moneys to Special Olympics Illinois to | ||
support the statewide training, competitions, and programs for | ||
future Special Olympics athletes; and (ii) 25% of the moneys | ||
to Special Children's Charities to support the City of | ||
Chicago-wide training, competitions, and programs for future | ||
Special Olympics athletes. The moneys may not be used for | ||
institutional, organizational, or community-based overhead | ||
costs, indirect costs, or levies. | ||
Moneys received for the purposes of this Section, | ||
including, without limitation, net revenue from the special | ||
instant scratch-off game and gifts, grants, and awards from | ||
any public or private entity, must be deposited into the |
Special Olympics and Special Children's Charities Fund. Any | ||
interest earned on moneys in the Special Olympics and Special | ||
Children's Charities Fund must be deposited into the Special | ||
Olympics and Special Children's Charities Fund. | ||
As used in this subsection, For purposes of this | ||
subsection, "net revenue" means the total amount for which | ||
tickets have been sold less the sum of the amount paid out in | ||
prizes and to retailers, and
direct and estimated the actual | ||
administrative expenses of the Department solely related to | ||
the Go For The Gold game. | ||
(c) During the time that tickets are sold for the Go For | ||
The Gold game, the Department shall not unreasonably diminish | ||
the efforts devoted to marketing any other instant scratch-off | ||
lottery game. | ||
(d) The Department may adopt any rules necessary to | ||
implement and administer the provisions of this Section.

Sec. 21.10. Scratch-off for State police memorials. | ||
(a) The Department shall offer a special instant | ||
scratch-off game for the benefit of State police memorials. | ||
The game shall commence on January 1, 2019 or as soon | ||
thereafter, at the discretion of the Director, as is | ||
reasonably practical. The operation of the game shall be | ||
governed by this Act and any rules adopted by the Department. |
If any provision of this Section is inconsistent with any | ||
other provision of this Act, then this Section governs. | ||
(b) The net revenue from the State police memorials | ||
scratch-off game shall be deposited into the Criminal Justice | ||
Information Projects Fund and distributed equally, as soon as | ||
practical but at least on a monthly basis, to the Chicago | ||
Police Memorial Foundation Fund, the Police Memorial Committee | ||
Fund, and the Illinois State Police Memorial Park Fund. Moneys | ||
transferred to the funds under this Section shall be used, | ||
subject to appropriation, to fund grants for building and | ||
maintaining memorials and parks; holding annual memorial | ||
commemorations; giving scholarships to children of officers | ||
killed or catastrophically injured in the line of duty, or | ||
those interested in pursuing a career in law enforcement; | ||
providing financial assistance to police officers and their | ||
families when a police officer is killed or injured in the line | ||
of duty; and providing financial assistance to officers for | ||
the purchase or replacement of bulletproof vests to be used in | ||
the line of duty. | ||
As used in this subsection, For purposes of this | ||
subsection, "net revenue" means the total amount for which | ||
tickets have been sold less the sum of the amount paid out in | ||
the prizes and to retailers, and
direct and estimated the | ||
actual administrative expenses of the Department solely | ||
related to the scratch-off game under this Section. | ||
(c) During the time that tickets are sold for the State |
police memorials scratch-off game, the Department shall not | ||
unreasonably diminish the efforts devoted to marketing any | ||
other instant scratch-off lottery game. | ||
(d) The Department may adopt any rules necessary to | ||
implement and administer the provisions of this Section.

(20 ILCS 1605/21.11) | ||
Sec. 21.11. Scratch-off for homelessness prevention | ||
programs. | ||
(a) The Department shall offer a special instant | ||
scratch-off game to fund homelessness prevention programs. The | ||
game shall commence on July 1, 2019 or as soon thereafter, at | ||
the discretion of the Director, as is reasonably practical. | ||
The operation of the game shall be governed by this Act and any | ||
rules adopted by the Department. If any provision of this | ||
Section is inconsistent with any other provision of this Act, | ||
then this Section governs. | ||
(b) The Homelessness Prevention Revenue Fund is created as | ||
a special fund in the State treasury. The net revenue from the | ||
scratch-off game to fund homelessness prevention programs | ||
shall be deposited into the Homelessness Prevention Revenue | ||
Fund. Subject to appropriation, moneys in the Fund shall be | ||
used by the Department of Human Services solely for grants to | ||
homelessness prevention and assistance projects under the | ||
Homelessness Prevention Act. |
As used in this subsection, "net revenue" means the total | ||
amount for which tickets have been sold less the sum of the | ||
amount paid out in the prizes and to retailers, and
direct and | ||
estimated the actual administrative expenses of the Department | ||
solely related to the scratch-off game under this Section. | ||
(c) During the time that tickets are sold for the | ||
scratch-off game to fund homelessness prevention programs, the | ||
Department shall not unreasonably diminish the efforts devoted | ||
to marketing any other instant scratch-off lottery game. | ||
(d) The Department may adopt any rules necessary to | ||
implement and administer the provisions of this Section. | ||
(e) Nothing in this Section shall be construed to affect | ||
any revenue that any Homelessness Prevention line item | ||
receives through the General Revenue Fund or the Illinois | ||
Affordable Housing Trust Fund.

Sec. 21.13. Scratch-off for Alzheimer's care, support, | ||
education, and awareness. | ||
(a) The Department shall offer a special instant | ||
scratch-off game for the benefit of Alzheimer's care, support, | ||
education, and awareness. The game shall commence on January | ||
1, 2020 or as soon thereafter, at the discretion of the | ||
Director, as is reasonably practical , and shall be | ||
discontinued on January 1, 2025 . The operation of the game |
shall be governed by this Act and any rules adopted by the | ||
Department. If any provision of this Section is inconsistent | ||
with any other provision of this Act, then this Section | ||
governs. | ||
(b) The net revenue from the Alzheimer's care, support, | ||
education, and awareness scratch-off game shall be deposited | ||
into the Alzheimer's Awareness Fund. | ||
Moneys received for the purposes of this Section, | ||
including, without limitation, net revenue from the special | ||
instant scratch-off game and from gifts, grants, and awards | ||
from any public or private entity, must be deposited into the | ||
Fund. Any interest earned on moneys in the Fund must be | ||
deposited into the Fund. | ||
As used in this subsection, For the purposes of this | ||

Sec. 21.15. Scratch-off for United Negro College Fund | ||
Illinois. | ||
(a) The Department shall offer a special instant | ||
scratch-off game for the benefit of United Negro College Fund | ||
Illinois in support of educational scholarships to university | ||
and college students. The game shall commence on January 1, | ||
2024 or as soon thereafter, at the discretion of the Director, | ||
as is reasonably practical. The operation of the game shall be | ||
governed by this Act and any rules adopted by the Department. | ||
The Department must consult with UNCF Illinois regarding the | ||
design and promotion of the game. | ||
(b) The UNCF Scholarship Fund is created as a special fund | ||
in the State treasury. The net revenue from the special | ||
instant scratch-off game sold for the benefit of the United | ||
Negro College Fund Illinois in support of education | ||
scholarships to university and college students shall be | ||
deposited into the fund for appropriation by the General | ||
Assembly solely to the Student Assistance Commission for the | ||
purpose of funding UNCF Illinois Scholarship awards to | ||
university and college students. Funding shall be used solely | ||
for scholarship awards and not to cover any administrative | ||
costs of the United Negro College Fund, Inc., a 501(c)(3) |
nonprofit recipient organization. | ||
Moneys received for the purposes of this Section, | ||
including, without limitation, net revenue from the special | ||
instant scratch-off game and from gifts, grants, and awards | ||
from any public or private entity, must be deposited into the | ||

other instant scratch-off lottery game. | ||
(d) The Department may adopt any rules necessary to | ||
implement and administer the provisions of this Section. | ||

Sec. 21.16. Illinois DREAM scratch-off. | ||
(a) The Department shall offer a special Illinois DREAM | ||
instant scratch-off game for the benefit of the Illinois DREAM | ||
Fund Commission. The new revenue from the Illinois DREAM |
scratch-off game shall be deposited into the Illinois DREAM | ||
Fund, a special fund that is created in the State treasury. | ||
Subject to appropriation, money in the Illinois DREAM Fund | ||
shall be used to assist in funding scholarships and other | ||
statutory responsibilities of the Illinois DREAM Fund | ||
Commission. The game shall commence on January 1, 2024 or as | ||
soon thereafter as is reasonably practical. The Department | ||
shall consult with the Illinois DREAM Fund Commission | ||
established under Section 67 of the Higher Education Student | ||
Assistance Act regarding the design and promotion of the game. | ||
(b) The operation of any games under this Section shall be | ||
governed by this Act, and any rules shall be adopted by the | ||
Department. | ||
(c) For purposes of this Section, "net revenue" means the | ||
total amount for which tickets have been sold less the sum of | ||
the amount paid out in prizes and the actual administrative | ||
expenses of the Department solely related to the Illinois | ||
DREAM scratch-off game. | ||
(d) During the time that tickets are sold for the Illinois | ||
DREAM scratch-off game, the Department shall not unreasonably | ||
diminish the efforts devoted to marketing any other instant | ||
scratch-off lottery game. | ||
(e) The Department may adopt any rules necessary to | ||
implement and administer this Section in consultation with the | ||
Illinois DREAM Fund Commission. |
(20 ILCS 1605/21.17 new) | ||
Sec. 21.17. Illinois Lottery Special Instant Scratch-off | ||
Task Force. | ||
(a) There is hereby created the Illinois Lottery Special | ||
Instant Scratch-off Task Force. | ||
(b) The Task Force shall study the joint special instant | ||
scratch-off game offered under Section 21.4 and make | ||
recommendations on: | ||
(1) maximizing revenue for this State as well as | ||
various special causes; | ||
(2) whether to expand the program to additional | ||
causes; | ||
(3) establishing criteria for special causes; | ||
(4) the impact on revenue of the joint special instant | ||
scratch-off game; and | ||
(5) other issues related to the joint special instant | ||
scratch-off game. | ||
(c) The Task Force may request testimony from any person | ||
or entity that may assist in increasing understanding of the | ||
joint special instant scratch-off game. | ||
(d) The Task Force shall consist of the following members: | ||
(1) the Director of the Lottery, or his or her | ||
designee; | ||
(2) 2 members, appointed by the Speaker of the House | ||
of Representatives, one of whom shall be named co-chair of | ||
the Task Force; |
(3) 2 members, appointed by the Minority Leader of the | ||
House of Representatives; | ||
(4) 2 members, appointed by the President of the | ||
Senate, one of whom shall be named co-chair of the Task | ||
Force; | ||
(5) 2 members, appointed by the Minority Leader of the | ||
Senate; and | ||
(6) 2 members, appointed by the Governor. | ||
(e) Members of the Task Force shall serve without | ||
compensation for the duration of the Task Force, but may be | ||
reimbursed for reasonable travel expenses and in compliance | ||
with the Secretary of State's travel rules required for | ||
attendance at meetings. | ||
(f) As soon as practicable, but no later than September 1, | ||
2023, all members shall be appointed to the Task Force. As soon | ||
as practicable after all members have been appointed, the Task | ||
Force shall hold its first meeting. The Task Force shall meet a | ||
minimum of 4 times. | ||
(g) The Department of the Lottery shall provide | ||
administrative support and other support to the Task Force. | ||
(h) By January 1, 2025, the Task Force shall submit a | ||
report to the Governor and General Assembly reporting findings | ||
and recommendations regarding the joint special instant | ||
scratch-off games. | ||
(i) This Section is repealed on January 1, 2027. |

Section 25. The Higher Education Student Assistance Act is | ||
amended by changing Section 67 as follows: | ||
(110 ILCS 947/67) | ||
Sec. 67. Illinois DREAM Fund Commission. | ||
(a) The Illinois Student Assistance Commission shall | ||
establish an Illinois DREAM Fund Commission. The Governor | ||
shall appoint, with the advice and consent of the Senate, | ||
members to the Illinois DREAM Fund Commission, which shall be | ||
comprised of 9 members representing the geographic and ethnic | ||
diversity of this State, including students, college and | ||
university administrators and faculty, and other individuals | ||
committed to advancing the educational opportunities of the |
children of immigrants. | ||
(b) The Illinois DREAM Fund Commission is charged with all | ||
of the following responsibilities: | ||
(1) Administering this Section and raising funds for | ||
the Illinois DREAM Fund. | ||
(2) Establishing a not-for-profit entity charged with | ||
raising funds for the administration of this Section, any | ||
educational or training programs the Commission is tasked | ||
with administering, and funding scholarships to students | ||
who are the children of immigrants to the United States. | ||
(3) Publicizing the availability of scholarships from | ||
the Illinois DREAM Fund. | ||
(4) Selecting the recipients of scholarships funded | ||
through the Illinois DREAM Fund. | ||
(5) Researching issues pertaining to the availability | ||
of assistance with the costs of higher education for the | ||
children of immigrants and other issues regarding access | ||
for and the performance of the children of immigrants | ||
within higher education. | ||
(6) Overseeing implementation of the other provisions | ||
of this amendatory Act of the 97th General Assembly. | ||
(7) Establishing and administering training programs | ||
for high school counselors and counselors, admissions | ||
officers, and financial aid officers of public | ||
institutions of higher education. The training programs | ||
shall instruct participants on the educational |
opportunities available to college-bound students who are | ||
the children of immigrants, including, but not limited to, | ||
in-state tuition and scholarship programs. The Illinois | ||
DREAM Fund Commission may also establish a public | ||
awareness campaign regarding educational opportunities | ||
available to college bound students who are the children | ||
of immigrants. | ||
The Illinois DREAM Fund Commission shall establish, by | ||
rule, procedures for accepting and evaluating applications for | ||
scholarships from the children of immigrants and issuing | ||
scholarships to selected student applicants. | ||
(c) To receive a scholarship under this Section, a student | ||
must meet all of the following qualifications: | ||
(1) Have resided with his or her parents or guardian | ||
while attending a public or private high school in this | ||
State. | ||
(2) Have graduated from a public or private high | ||
school or received the equivalent of a high school diploma | ||
in this State. | ||
(3) Have attended school in this State for at least 3 | ||
years as of the date he or she graduated from high school | ||
or received the equivalent of a high school diploma. | ||
(4) Have at least one parent who immigrated to the | ||
United States. | ||
(d) The Illinois Student Assistance Commission shall | ||
establish an Illinois DREAM Fund to provide scholarships under |
this Section. The Illinois DREAM Fund shall be funded entirely | ||
from private contributions , gifts, grants, awards, and | ||
proceeds from the scratch-off created in Section 21.16 of the | ||
Illinois Lottery Law .
