CHAPTER I: DEPARTMENT OF PUBLIC HEALTH SUBCHAPTER b: HOSPITALS AND AMBULATORY CARE FACILITIES PART 250 HOSPITAL LICENSING REQUIREMENTS SECTION 250.1035 DOMESTIC VIOLENCE STANDARDS
Section 250.1035 Domestic Violence Standards
A hospital licensed under the Act shall comply with the following standards relating to domestic violence (Section 6.01 of the Act) (see Hospital Accreditation Standards (HAS) of the Joint Commission on Accreditation of Healthcare Organizations, Section 250.160):
a) Hospitals shall have policies regarding the identification of possible victims of
abuse.
b) Hospital policies regarding possible victims of alleged or suspected abuse or
neglect shall address patients' special needs relative to the patient assessment
process, including consent, evidence collection, notification and release of information to authorities, and referrals to community agencies. c) Nothing in this Section requires hospitals to adopt new policies regarding domestic violence if their existing hospital policies meet the requirements of this Section.
