SYNOPSIS AS INTRODUCED:

415 ILCS 5/59.18 new

Amends the Carbon Capture and Sequestration Title of the Environmental Protection Act. Prohibits a person from conducting a carbon sequestration activity over any federally designated sole source aquifer. Prohibits the Environmental Protection Agency from issuing a carbon sequestration permit if the Agency knows that the applicant is intending to conduct carbon sequestration activity over any federally designated sole source aquifer. Effective immediately.

A BILL FOR

AN ACT concerning safety.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Environmental Protection Act is amended by adding Section 59.18 as follows:

(415 ILCS 5/59.18 new)

Sec. 59.18. Sole source aquifer carbon sequestration operations prohibited. No person shall conduct a carbon sequestration activity over any federally designated sole source aquifer, including, without limitation, the Mahomet Sole Source Aquifer. The Agency shall not issue a carbon sequestration permit under this Title if the Agency knows that the applicant is intending to conduct carbon sequestration activity over any federally designated sole source aquifer, including, without limitation, the Mahomet Sole Source Aquifer.

Section 99. Effective date. This Act takes effect upon becoming law.
